10 States Sue Over Restrooms Transgender Students Can Use

LINCOLN, Neb. — Jul 8, 2016, 2:14 PM ET

Ten states sued the federal government Friday over rules requiring public schools to allow transgender students to use restrooms conforming to their gender identity, joining a dozen other states in the latest fight over LGBT rights.

The lawsuit was filed in federal court in Nebraska and included nine other states: Arkansas, Kansas, Michigan, Montana, North Dakota, Ohio, South Carolina, South Dakota, and Wyoming.

The filing comes after 11 states sued in May over the same Obama administration directive. North Carolina officials also sued the federal government in May over the same issue. Vast sums of federal funding are at stake: Money could be withheld from public schools that refuse to comply with the federal directive.

Nebraska Attorney General Doug Peterson said in a news release that the U.S. Education Department and Justice Department have circumvented established law and the process for changing existing laws.

They will lose, you take the money from the Violence Against Women Re-authorization Act of 2013, and sign the contract agreeing to the terms which was required to receive the money, you can't later say we now disagree with it.

No person in the United States shall, on the basis of actual or perceived race, color, religion, national origin, sex, gender identity (as defined in paragraph 249(c)(4) of title 18, United States Code), sexual orientation, or disability, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any program or activity funded in whole or in part with funds made available under the Violence Against Women Act of 1994 (title IV of Public Law 103–322 ; 108 Stat. 1902), the Violence Against Women Act of 2000 (division B of Public Law 106–386; 114 Stat. 1491), the Violence Against Women and Department of Justice Reauthorization Act of 2005 (title IX of Public Law 109–162 ; 119 Stat. 3080), the Violence Against Women Reauthorization Act of 2013 , and any other program or activity funded in whole or in part with funds appropriated for grants, cooperative agreements, and other assistance administered by the Office on Violence Against Women.

18 U.S. Code § 249 C4 states
(4) the term “gender identity” means actual or perceived gender-related characteristics

The term underserved populations means populations who face barriers in accessing and using victim services, and includes populations underserved because of geographic location, religion, sexual orientation, gender identity, underserved racial and ethnic populations, populations underserved because of special needs (such as language barriers, disabilities, alienage status, or age), and any other population determined to be underserved by the Attorney General or by the Secretary of Health and Human Services, as appropriate.

Watching the PBS show, 9 Months, I did not know a developing fetus gets a shot of testosterone at around 12 weeks that determines the sex of the person, however, the sex of the brain is not determined until another shot of testosterone happens about a month later. It is a simple fact of fetal development that some get differing levels of testosterone and so may have the sexual organs for a male or female and the brain development of the other sex.

Call me stupid but I never knew that. I also never knew we had all the brain cells we will ever have by 20 weeks. It's an interesting show.

It's a myth that brain cells can't be regrown. But yeah, there's like six+ different major development stages related to sex, none of which are automatic or have uniform outcomes.
