Conservative Group Sues NC Elections Board Over Same-Day Registrations

A conservative group in North Carolina filed a lawsuit Monday against the North Carolina state Board of Elections seeking to delay its certification of the 2016 elections until it has gone through the lengthy process of verifying the addresses of voters who registered to vote on the same day they voted.
The lawsuit comes as the sitting governor refuses to concede his defeat. Republican Gov. Pat McCrory trails Democratic Attorney General Roy Cooper by some 5,000 votes. McCrory is claiming widespread voter fraud and is challenging ballots in dozen of counties as he tries to close the gap with Cooper.
McCory is under pressure from Democrats to concede. The new lawsuit, while not focused solely on the governor's race, could buy McCory more time by postponing the official certification of the results until well into December.
The Civitas Center for Law and Freedom wants the Elections Board to hold off on certifying the election results until county election officials have completed a laborious process of verifying by mail the addresses of same-day registrants.

(1,142 posts)They are talking about using two different state laws, one that let's them challenge the election claiming it's too close to call, so that the decision can be made by the legislature and their choice would not be able to be reviewed by courts.

But the immediate question in North Carolina is how long Mr. McCrory will dispute the results and whether he might ultimately ask the General Assembly to consider the election.
Under state law, the legislature could order a new election or, if it can determine which candidate received the highest number of votes, it may declare a winner. The law asserts that the legislatures decision in such a contest is not reviewable by the courts.
And on another front, they are so mad about the State Supreme Court judge that they backed lost that there are a lot of rumors that state they are looking at a law that would allow them to add two more judges to the court so that Mc Crory would be able to stack the court with conservative judges prior to leaving office, it's a real case of sore losers, trying to defy the will of the electorate here

In an election upset Tuesday, Democrat Mike Morgan won over Republican incumbent Justice Bob Edmunds, effectively flipping the court from a 4-3 Republican majority to 4-3 Democratic control.
Theres since been speculation that legislative leaders will force a vote in an emergency special session called to address Hurricane Matthew to add two additional associate justices in an effort to reestablish the Republican majority, a move that is allowed by the North Carolina Constitution.
Former Justice Bob Orr and Common Cause North Carolina Executive Director Bob Phillips both said Thursday that theyve heard rumors about plans to expand the court.
House Speaker Tim Moores spokesman said Thursday that he would not be available for comment. Senate President Pro Tem Phil Bergers spokespeople did not return a message for comment. Senate minority leader Dan Blue declined to comment.

(7,901 posts)The GOP in NC is wholly owned by Art Pope and the Koch brothers, that includes the asshole governor and much of the legislature. They got into power on a razor thin majority and have maintained it through gerrymandered districts and bent voting machines. We've been hostages to their Neo-christian insanity ever since.
The voting majority of NC citizens do not approve of their rule nor their attitudes, but we are constrained by the gerrymandered districts. I guess that did not appear in your local press. NC was a moderately democratic state for most of the last 40 years. If you cannot be bothered to read history you can at least be accurate in your denunciations.
If you need to blow your anger at a GOP target try the soon to be ex-governor and the poodles in the legislature. Not to mention the whole Koch lead conspiracy that denied and stole the Presidential and Senate votes here in NC. Those are the FACTS Jack!
