The Supreme Court's next big gun case could determine whether you have a constitutional right to car

Edward Peruta is a litigious Vietnam veteran who spends part of each year living out of a trailer home in San Diego.

Neil Gorsuch is a conservative Coloradan with impeccable Ivy League judicial credentials.

Peruta’s legal challenge to San Diego County’s concealed carry permitting system has been winding its way through the federal court system since 2009.

Gorsuch was sworn in as the newest associate justice of the Supreme Court just four days ago.

On Thursday, their fortunes will meet when Gorsuch joins his first-ever Supreme Court conference to discuss whether the bench should hear Peruta v. California , which asks whether the Second Amendment protects a right to carry guns in public spaces. It could be the most consequential gun case since the Court confirmed the individual right to bear arms in District of Columbia v. Heller nearly a decade ago.

So many unnecessary deaths each year because too many love guns more than humans. What about others rights to safety? What about the right to be free from fear. When I see someone carrying a gun, I'm automatically fearful of that person and try to put a lot of distance between me and them. How is that respectful of my human rights when gun brandishing menaces are walking around, just waiting to pull the trigger?

One legislates the right not to be threatened in public by gun carriers by not allowing guns in public places, for a start.

Not that I support open carry but at least you know who is armed.

Nobody really knows how he'll vote. If he sides with the liberal wing, the outrage from the right that Trump put another Souter on the bench will be deafening.

I highly doubt Gorsuch will ever be siding with anything remotely liberal. He's really on the corporate side of things, seems to always vote for them instead of for the people.

Wish I could read the article but the ad blocker is gonna stay.

Bummer.

Here's my question, is this case based on the idea that he thinks he should be able to carry no matter where he goes? If he wanted to come in my house packing a gun should I have a right to say no? Is that his argument? I get that my house is not the same as a business, but a business IS still private property, as far as I know...

Wow.

onto your property. You just don't have control over public spaces.
In Texas (open carry as of 2 years ago), if you don't want guns in your business, you post a warning saying that you opt out of the open carry law, and no one may carry inside. If someone does carry despite the warning, you can ask them to leave, or you can call the police if you don't feel safe. You are the ultimate authority on your own property.

People in Texas have compiled a list of stores, restaurants and other businesses that have these signs up, and many people (my mother included) have used this list to make purchasing decisions.
Now, there are businesses where open or concealed carry is allowed. So you pretty much have to put up with it as long as that's the law in Texas. Other states do it differently.

To forbid concealed carry you must also post a 30.06 sign.

There are also specific letter sizes and sign placement in the law.

In any case, it's about the 'good cause' that some counties have for concealed carry.

IOW, you have to show the authorities that you have a good reason to carry a weapon and it is at the discretion of those authorities who gets one and who doesn't. Fear for personal safety does not meet that requirement.

The way this usually works out, the rich and connected in the area receive their permits and the poor and unconnected do not.

'Would you care to donate the the Sheriff's charity fund while you are here applying?' etc.. etc..
