Judge orders CIA interrogation lawsuit to trial

SEATTLE (AP) — A federal judge in Spokane on Monday officially denied a request to throw out a lawsuit against two psychologists who helped design the CIA's harsh interrogation program used in the war on terror.

In his written order, U.S. District Judge Justin Quackenbush said a jury will hear the lawsuit filed by the American Civil Liberties Union on behalf of three former detainees against James Mitchell and John "Bruce" Jessen, who were under contract with the federal government following the Sept. 11 terror attacks.
 
The lawsuit claims the psychologists "designed, implemented, and personally administered an experimental torture program for the U.S. Central Intelligence Agency." Under the program, detainees were subjected to physical assaults and sleep deprivation, forced to stand for days in diapers with their arms chained overhead, doused with icy water and stuffed into boxes, the ACLU said.
 
Quackenbush heard arguments from both sides on July 28 and issued a partial ruling in which he said he would consider whether all three detainees, Suleiman Abdullah Salim, Mohamed Ahmed Ben Soud and the estate of Gul Rahman, who died in custody, should be included the lawsuit.

Amendment VIII

Excessive bail shall not be required, nor excessive fines imposed, nor cruel and unusual punishments inflicted

I have read, and even taught and been taught..that this "Amendment VIII" of the...Constitution of the United States..is the supreme law of the land..and I was told, that means it.."Constitution of the United States"..goes above all other laws....that is what I was told..

This Constitution, and the Laws of the United States which shall be made in Pursuance thereof; and all Treaties made, or which shall be made, under the Authority of the United States, shall be the supreme Law of the Land; and the Judges in every State shall be bound thereby, any Thing in the Constitution or Laws of any State to the Contrary notwithstanding..........

Therefore, the cruel and unusual punish stuff...discussed in the OP....is illegal, because of post number 2 and this post...(that is Amendment VIII, and Article VI ..2nd Clause.)

According to Cornell University Law School .............."The Supremacy Clause of the United States Constitution (Article VI, Clause 2) establishes that the Constitution, federal laws made pursuant to it, and treaties made under its authority, constitute the supreme law of the land. footnote[1] It provides that state courts are bound by the supreme law; in case of conflict between federal and state law, the federal law must be applied. Even state constitutions are subordinate to federal law " footnote [2]
