Eric Bolling initiates lawsuit against reporter behind sexting story
Source: Politico
Fox News host Eric Bolling has initiated a lawsuit against the reporter behind the report that led to his suspension.
Yashar Ali, a contributing writer for HuffPost, reported on Friday that several years ago Bolling sent lewd text messages that included photographs of male genitalia to two female colleagues at Fox. The next day Bolling was suspended and Fox launched an investigation by the same law firm that handled probes into the conduct of former host Bill O'Reilly and former Fox chairman Roger Ailes.
After the initial report, Bolling said, via his lawyer, that he "recalls no such inappropriate communications, does not believe he sent any such communications, and will vigorously pursue his legal remedies for any false and defamatory accusations that are made.
On Wednesday, Bolling filed a "summons with notice" in New York State Supreme Court against Ali, seeking $50 million in damages for defamation. Ali must respond within 20 days, demanding that Bolling file a complaint, after which Bolling will have 20 days to file his response before the suit goes forward.

Boling's attorney is from Marc Kasowitz law firm, which suggests a legal strategy involving bullying and browbeating.

(7,530 posts)It implies he has sent dick pics to someone at some point in time and can't outright deny it completely as one would: "The allegations are false because I know for sure I have never actually taken pictures of my genitals."
And there are really few reasons to take pictures of your genitals on a phone unless intending to show someone.

(27,815 posts)Perfectly reasonable response. How many men send pics of male genitalia to women coworkers and simply don't remember doing so? It's just the kind of thing that would slip one's mind.

(35,320 posts)It's really a way of getting the reporter to either recant or substantiate his claims.
That could involve somebody who received them having kept them or several people independently remembering them. Either way, you get names.
Or you get the report recanted, and while the accusation is sufficient evidence of guilt for many people, it can lead to additional legal action or to his continuing to work someplace with the assumption that the stigma of an unsubstantiated allegation will fade.
(Look, I've been on the receiving end of allegations from 3 people that supposedly all recalled independently what I said. One person twisted something and then next I know two additional people confirm it, so all the facts are established before I'm even asked what happened. Work became hell. Except that one person was there and months later remembered that the conversation occurred while the second person was in the bathroom--we were waiting for her to finish. And the third person, when asked about details, wasn't there at all but across town. There had to be four of us there because we were playing hearts--and when that third person couldn't have been there it was suddenly remembered that there *was* somebody else there, who just happened to in town for a week when the conversation happened. He was called. He cleared me. By then I'd been so insulted, curtailed, abused, that I had quit. So how many independent witnesses were there? One. And she got it wrong because she was far from the sharpest tool in the shed. Result: I don't like herasay and unsubstantiated allegations. Even when several people remember something clearly, unless you challenge them instead of just pumping them for information you may not realize that all the stories stem from one person. Now, if that one person has proof, great. If that one person doesn't, that one person may be exaggerating, lying, telling just part of the truth, or telling the whole truth--you just can't tell.)
