Right-wing protester charged in Berkeley riot back in custody

OAKLAND A self-proclaimed American nationalist arrested after a violent Berkeley riot in March was sent back to jail Thursday after a judge increased his bail because he was found in possession of a weapon.
Kyle Stickman Chapman, 42 of Daly City, was remanded back into custody after appearing in court Thursday afternoon for a bail hearing. In a video he posted publicly on Facebook, Chapman is seen off-roading in a truck in a state park in San Francisco. The truck, a Jeep-type vehicle, had Trump and American flags on it. A park ranger pulls it over and arrests Chapman, who is found in possession of a Kubaton key-chain, Chapman explains in one of his videos.
The keychain is a type of self-defense weapon stick, according to the companys website, which can be lethally used.
Alameda County prosecutors requested a bail increase after the incident.

(33,643 posts)Are the Courts really going to be THAT trifling? I mean ... a friggin' KEY itself could be 'lethally used' ... if you jam it into someone's eyeball.
To be quite honest, I'm a bit more concerned with someone 'off-roading' in a 'State Park' in San Francisco. Cause I know the area pretty damn well, having grown up in the East Bay and having been ALL OVER SF, about 1000 times ... and I don't really know of a single place you're legally allowed to 'off road in your Jeep' ... unless maybe they mean SF County, as opposed to City of SF. Maybe I'm just not thinking of a particular place where that's legal ...
Busting someone for THIS ... even if they're on probation ... is pretty friggin' bullshit, honestly ... let's not cross the line into full-blown stupid, here ... It's 7" STICK for f***s sake.

Except as provided in Section 22215 and Chapter 1 (commencing with Section 17700) of Division 2 of Title 2, any person in this state who manufactures or causes to be manufactured, imports into the state, keeps for sale, or offers or exposes for sale, or who gives, lends, or possesses any leaded cane, or any instrument or weapon of the kind commonly known as a billy, blackjack, sandbag, sandclub, sap, or slungshot, is punishable by imprisonment in a county jail not exceeding one year or in the state prison.
I noticed you picked the most "innocent" looking Kubotan. He's a few other ones.

That being said, no matter how much I don't like a person, completely taking away a person's ability to defend themselves doesn't feel right.
If this was a female, and she had gotten in similar trouble, with similar sentencing, then gotten busted simply for CARRYING a small can of defensive Pepper Spray ... not using it, but having it ... I wouldn't really be down with that. You?

I don't think you (presumably) or I would get in trouble in CA for having a Kubaton, IOW.
Not sure where you're coming up with the idea that everyone gets in trouble for having one of those in CA. My understanding from the story is that he's in trouble due to terms of his bail/probation, not for breaking a law that applies to non-criminals.
"The prosecution argued that Chapman was ordered to have no deadly weapons of any kind when he was released after posting bail, which was initially set at $135,000. Judge Yolanda Northridge ruled that while unfortunate that Chapmans car was broken into, he did not need the weapon to protect himself."
Maybe I misunderstand though.
So, since we're actually dealing with actually potentially deadly weapons, and pepper spray is not one of those ... lets say a female was ordered to carry no deadly weapons because she was released on bail for a violent act, and she was caught with a taser (a device which has killed some people, albeit it's generally associated with self-defense, like a Kubaton key chain) which she claimed was for protection against potential rapists ... would you grant that this was an unfair restriction on her right to self-defense?
Because I would.

Look I hate this a-hole, Berkeley is practically my home-town ... but people need to be able to defend themselves. If they can't be trusted to have a defensive weapon with which to do so ... then just keep them in jail.

(16,065 posts)Of his agreement. And that is what bail is, an agreement. He did not have to leave jail. He agreed to abide by certain rules. He didn't live up to his part of the deal.

(33,643 posts)I definitely don't know of a place even in the County one can legally 'off-road' (esp. not in a damn Jeep) tho ... but at least I can think of some parts where it might conceivably be in the County ... def not The City though ... hell no ...

(38,317 posts)The parks -- city, state, and national -- are all urban parks, the sorts of places people go jogging with their dogs, go for a picnic on a date, or a hike with the kids. I think the hills, rocks, steep Pacific Ocean cliffs, and vegetation make San Francisco's parks seem larger and much less urban than they actually are, but all are roughly equivalent to New York City's Central Park, and nope, not places for off-roading.
