Judge dismisses defamation suit against journalist who suggested woman used white power gesture at White House

A federal judge in Washington, D.C. on Wednesday dismissed a defamation lawsuit against a former Fusion reporter.

In the ruling, U.S. District Judge Trevor McFadden said that the plaintiff, Cassandra Fairbanks, failed to prove that reporter Emma Roller intentionally defamed her when she suggested in a tweet that Fairbanks had made a "white power hand gesture" in a photo taken at the White House.

"This 'fundamental principle of our constitutional system' obligates Ms. Fairbanks, as a public figure, to support her defamation claim by alleging facts that support a finding of actual malice on the part of Ms. Roller," McFadden wrote.

"Because Ms. Fairbanks has failed to allege such facts, Ms. Roller’s Motion to Dismiss under the Federal Rules of Civil Procedure will be granted."

How is the "okay" hand gesture/symbol a white power thing? Is it because of the guy she's standing next to? I feel like I'm missing some important context here. I've never heard of her or the guy in the photo with her.

The three fingers represent the W, & thumb and forefinger with the hand make the P.

It's prison gang symbol. if a prisoner is caught flashing that in prison by a custody officer, there's hell to pay.

we know its a trump gesture and we know "some" Republican voters/trump supporters use that sign as a white supremacist 'hand sign', we know those two people have a fairly nasty history- the courts have to be given proof.

Journalists should and are continuing to fight in the courts. This is not the only court case.
