Susan Collins Says She Would Vote Against Any Trump Nominee Who Wants to Overturn Roe v. Wade

The pro-choice Republican said Sunday that a nominee who wants to overturn Roe would be "unacceptable."
Any Supreme Court nominee who would overturn Roe v. Wade would be unacceptable to her, said US Senator Susan Collins (R-ME), one of the most closely watched lawmakers as Trump moves to nominate a replacement for outgoing Justice Anthony Kennedy.
Trump has vowed to appoint justices that would overturn the landmark case affirming abortion as a constitutional right. His next appointment will determine the courts majority, leaving abortion rights in the balance as Kennedy retires from the high court.
Speaking to ABC television on Sunday, Collins, a rare pro-choice Republican, said she was going to have an in-depth conversation with the nominee and reiterated what she said last week that she believes Roe v. Wade is settled law.
It has been established as a constitutional right for 45 years and was reaffirmed 26 years ago, Collins said. So a nominees position on whether or not they respect precedent will tell me a lot about whether they would overturn Roe v. Wade. more..

In a statement Wednesday, Murkowski said she would carefully scrutinize Trumps pick, adding that she believes Kennedy the swing vote on abortion issues held the court together and did right by the Constitution.

(46,016 posts)I'm thinking that with Gorsuch, it didn't matter what any Dem did, so it was no big deal for Dems in red states to vote to confirm him. I have a feeling this will be different (If we can get a Republican to be reasonable). I imagine the pressure on Manchin et al. from Dems will be pretty severe. We will, though, have to make sure all the Dems hear from us.
I'll be on the phone with Harris and Feinstein.

I suspect that hell have no trouble doing so if it comes down to it... but Collins etc. will almost certainly find enough cover that it wont come to that

Edit for clarity:
Currently, they have 51 senators, including McCain. We have 49.
If Collins came over to our side, that would be 50/50. However, if McCain is unable to vote, the vote would be 49 yes and 50 no. There is no tie for Pence to break. I don't believe he can vote to create a tie, only to break one. So, the nominee would be defeated.
Of course, that all assumes: a) all the dems and our independents stick together, b) one Republican votes against, and c) McCain is unable to vote.
I'm not wishing his death on him, but I'm also not wishing the Repigs forcing him to DC to vote while he's in the process of dying.

(7,884 posts)51 to 49. Take away McCain, it's 50 to 49. Add one Republican to our number (I guess possibly Collins) and that would make it 50 to 50 with Pence being able to vote to break the tie. I think that's where it would stand but I'm not sure...

The way you have it: 50/50 assumes McCain is voting.

Collins said she wouldn't vote for a candidate who SAYS that they would vote against Roe. But if nobody presses them to answer that question then she is off the hook.
How can the good people of Maine keep voting for her? I have less respect for her than Mitch - kinda. At least he's consistent and forthright about being an evil scumbag.

I like to think that the trauma of thinking your own daughter or granddaughter could be so adversely affected by such a decision on a SC justice would seriously weight on your mind, even if you are a republican.

I know, it's a bit of a pipe dream, but think of it. Flake and Corker don't have a damn thing to lose. They're dead politically as Rethugs anyway. They couldn't get elected ag commissioner back home. During the confirmation process, it was revealed that Alito wrote in a 1985 memo that the government "should make clear that we disagree with Roe v. Wade."
In his confirmation hearings, Alito also refused to call Roe "settled law."

Collins spends time in front of cameras swearing to hold her ground and never vote for anyone who would be willing to overturn Roe. She won't come out and directly ASK this question, but she will ask about "stare decisis" and the answer will be some convoluted, nebulous word salad that sounds like "yes", but never really says it. (i.e., "We have had many great jurists in our history, and I would be hard pressed to question their decisions".) Based on this, and after McConnell personally promises her Roe would not be in danger, she will do what McConnell tells her to do, and votes for confirmation. Now a member of SCOTUS, the candidate votes at first opportunity to overturn Roe. Collins is shocked and dismayed.

Meanwhile the democrats had entered evidence against the nominee where they state they are pro-life and think R v W should be overturned.
How would it work when during a confirmation hearing the nominee says that they would never vote to overturn Roe vs Wade but would consider restrictions then once on the bench they vote to overturn it?
