SACRAMENTO, Calif. A judge on Monday dismissed the federal governments claim that U.S. law trumps two California laws intended to protect immigrants who are in the country illegally.
...............................................
Mendez rejected the U.S. governments argument on two of the laws that the U.S. Constitution gives the federal government pre-eminent power to regulate immigration. The Trump administration argued that California is obstructing immigration enforcement efforts.
The twin rulings by Mendez, who was nominated to the federal bench by Republican President George W. Bush, allow California to continue limiting police cooperation with immigration officials and require inspections of detention facilities despite the Trump administrations lawsuit filed in March.
California Attorney General Xavier Becerra, in a statement, called the decision a victory for our States ability to safeguard the privacy, safety, and constitutional rights of all of our people. Though the Trump Administration may continue to attack a state like California and its ability to make its own laws, we will continue to protect our constitutional authority to protect our residents and the rule of law...................................
FILE - In this Aug. 31, 2016, file photo, the dome of the state Capitol glows in the early evening in Sacramento, Calif. A federal judge has dismissed the federal governments claim that U.S. law trumps two California laws intended to protect immigrants who are in the country illegally. The ruling by U.S. District Judge John Mendez follows his ruling last week that found California was within its rights to pass two of the three sanctuary laws. Mendez ruled Monday, July 9, 2018, that the federal government could proceed with its attempt to block part of a third California sanctuary law. (Rich Pedroncelli, File/Associated Press)

(130,731 posts)detention of migrant families, a significant legal setback to the presidents immigration agenda.
In a ruling that countered nearly every argument posed by the Justice Department, Judge Dolly M. Gee of the Federal District Court in Los Angeles held that there was no basis to amend a longstanding court decision that forces the government to avoid holding migrant children for longer than 20 days.
Judge Gee said the administrations request was a cynical attempt to shift immigration policymaking to the courts.'>>>
