Prior to charging, does the suspect in a case like this receive a medical or mental health evaluation?

(26,325 posts)It seems typical to add hate crime later as the case progresses.
The nice thing about idiots like this is they usually hang themselves with their mouths.
When I argue with dip shit conservatives and they say how do you know it was hate? I say usually these morons open their mouth and prove the case themselves.

(89,247 posts)Because i read the person who witnessed the attack took a pic and told her. That's when she gave the excuse he had touched her daughter.
But I'm not sure that is the pic taken by that witness.

(8,311 posts)... represent her best interest, as all defendants are entitled to -- and shitty representation rightly results in many overturned convictions. Anyone who truly wants justice wants as fair of a trial as is possible to get.
However, true legal insanity is a high bar, and temporary insanity is sometimes even higher. As both are affirmative defenses, like self-defense, that places the burden of proof on the defense.
It would probably be smarter for her attorney to first let them attempt to prove their case through an evidentiary hearing, etc, before deciding on any affirmative defense Mental health evaluations are quite common in sentencing for mitigation factors, so I'm certain even issues that wouldn't eliminate criminal responsibility would be factored in if her attorney does their job.
It might even be smarter to attempt to negotiate a plea vs attempt an affirmative defense.
I'm speaking strictly to the question of how a good attorney should try to get the best possible outcome for their client -- and that duty of zealous representation should be respected. It's one of the many problems with our criminal justice system that public defenders are often young and inexperienced, burned out after doing what many see as a thankless job, or so overburdened they can't adequately represent people. And you might wonder how anyone could BE a defense lawyer, especially if they believe their client is guilty. It's still their job to negotiate the best deal they can get, or to respect not wanting to deal and try their best to raise reasonable doubt without lying or knowingly allowing perjury.
But if we want justice, we also must want every defendant to have a lawyer who will do their job well.

"The charging document alleges that Jones was previously convicted of making criminal threats in 2017. CBS2s Cristy Fajardo reported from the Compton courtroom and said Jones was on probation for this case."
