Nearly 100,000 comments on Betsy DeVos's plan to overhaul rules on sexual assault probes

Tens of thousands of public comments have poured into the Education Department in response to proposed rules guiding how schools handle sexual assault allegations, with universities, attorneys for the accused, women’s groups, angry students and parents weighing in on the emotional subject.

Education Secretary Betsy DeVos said the rewrite was needed to balance the rights of assault survivors with those who are accused, and to inject more due process into a high-stakes process. She holds final say over the regulation. Even so, her rules could be overturned by Congress, with newly empowered Democrats pushing for action and eyeing a possible higher-education bill as one way in.

The deadline for submitting comments to the Education Department was Wednesday, and as of midnight Tuesday, nearly 97,000 had been received, with more expected on the final day. It was not possible to assess the overall response but many voiced anger at DeVos’s approach.

“This is the most controversial regulatory undertaking in the history of the Department of Education,” said Terry Hartle of the American Council on Education, which represents university presidents. He estimated the volume of submissions would total 20 times what is typically received for a major regulatory proposal.

1. "How Schools Handle ...?" I have a real simple answer ... THEY DON'T

They hand over whatever evidence they have to the POLICE, who's freaking job it is ... to investigate CRIMES.

What do 'schools' have to figure out or do, other than going to the Police?

Although I suppose in some places the Cops are so corrupt that Schools maybe owe more to their Students and their families than to just leave such investigations in the hands of the local police ... and what sad statement that is, really ...

But I'm guessing that concept isn't that what Betsey is implying with her little 'proposal' here, is it? Encouraging schools to provide MORE protection for Victims ... is really not part of the agenda, I'd guess?

2. Schools need to decide whether

it is safe for individuals to be on campus. Also whether the conduct of individuals while it does not rise to the level of criminal behavior, makes accessing the university difficult for its students. One example would be a graduate student who teaches a section continually requesting dates from one of their students. As I understand deVos' proposed rules, if that is done off campus, it is not the concern of the university. In fact implying sex for grades might not even fall under the auspices of the university under her rules. That also may not be a crime in many states.

You are right that sexual assaults should immediately be brought to the attention of the justice system. That is why I think that staff and faculty should be mandatory reporters. What deVos' proposes means a large portion of campus personnel are not obligated legally to report misconduct.

In terms of access to the campus. Does someone who is accused but not charged with rape be denied access to the campus? How about someone who is charged but not yet tried? Under her rules it appears that action can't be taken in these cases.

young white men who think the sexual molestation of women is a "right of passage" into the adult world of people like Donald Trump and Brett Kavanaugh. These young men - usually from wealthy, connected Republican families - have been preyed upon by young women who think their bodies aren't playthings for spoiled little rich boys. The nerve of these young women! It's about time the playing field has been leveled for these fine young men!

As if it's necessary....

doesn't help either. I guess Betsy and Little Donnie are paving the way for their male grandchildren to have their way with young women at their convenience with no repercussions.

6. It is very obvious that DeVos never has been sexually attacked.

Maybe if she got violently raped she would change her tune drastically. I am not wishing that on her but I know that would make any women like her change their tune. What a bitch.

8. Or she has sons and their safety against false accusations

is more important than any little drunk slut who tempted them.

They were discussing this on NPR and they said that mothers had written in about their sons being suicidal after being falsely accussed. All I could think was just because an accused man is suicidal doesn't mean he's innocent. He can be guilty AND suicidal over getting caught.

Or her brother, the prince of mercenaries.

Just when you think this woman could not be more brainlessly unsuited for her position, she ups the ante again.
