Days after Dallas police upgraded the charges against a Deep Ellum bartender who was caught on camera viciously assaulting a Black woman, investigators have now charged the victim with a felony.
LDaijohnique Lee, 24, was hit with a criminal mischief charge Thursday afternoon after police said she knocked out a window of Austin Shuffields pickup truck after their altercation in the early morning of March 21, officials confirmed at a news conference.
Deputy Chief Thomas Castro said Lee admitted to breaking the windshield with a jump box, a charger for a car battery, causing damage estimated to be over $3,000, according to the Dallas Observer. Criminal mischief in the state is considered a felony if the damage exceeds $2,500.
We understand that some people are upset, Castro said at the news conference. Its not the intention of the Dallas Police Department to pick one side or the other. We simply had information that was provided to us on a criminal offense. We thoroughly investigated that offense. We took the action that was taken today.

(52,286 posts)the guy is being charged with several offenses, including simple assault which from what i can gather is in the process of being upgraded to aggravated assault, which seems about right. i hope she sues him to pay her medical bills and pain and suffering as well.
that said, what he did to her doesn't give her license to destroy the windshield of his car, and if she admitted she did this to the police, i don't know why anyone would expect the police not to take action against someone who confessed to a felony.
i would hope the prosecutor would take a more lenient view, given that she wouldn't have had motive to do anything like this had it not been for the guy attacking her in the first place. i'm curious as to the timing -- how long after the attack did she damage the windshield? the closer it was to the attack, the more she can claim altered mental status due to the attack. if she went home and came back to damage the windshield, that's more of a problem.
i'm guessing there's a misdemeanor charge that would be more appropriate assuming there wasn't the kind of criminal intent usually required for felonies. i certainly don't think she should end up in jail. also not clear how the windshield damage really is $3000, that seems steep.
unfortunately, she should also be liable to pay for fixing his windshield, which seems ridiculous, but like i said, she had no right to damage his property.

That leaves anyone reading the OP with the only option of thinking the OP agrees with the the content and tone of the headline and story they posted. That what they posted is their opinion because it stands without comment or contradiction.
If the OP had some thoughts that were in opposition to the provocative headline they should have posted them.

Posting an article which is open for either informing other DU'ers, or encouraging discussion after the original article is simply meant to introduce new material, "the news."
I saw your comment and assumed you were befuddled. Had no idea you were attempting to take a kick at me.
I'm not interested in a scrap with everyone every time I post an LBN article. I wouldn't have time to keep looking for new articles to post if I thought it was expected I wait around to see if anyone wanted to argue with me over the content of simple news.
As you were already informed, the headlines are created by the organization which publishes the article.
If you want to gibber on about your belief this black woman should pay through the nose for damaging the hate-filled monster's pick-up's windshield, that's your business. I think he probably should take it up with his insurance company.
I hardly think it's worth trying to kick up a scuffle about, or paying much attention to defenders of the racist filth who beat her down.

Again, had no idea I answered the wrong post number. That doesn't happen often. Can't remember if it ever has.

(14,175 posts)The police could use discretion and look at it like a byproduct of the total incident. She was reacting back, against her attacker, in a way that she knew would hurt him, because she knew her fists wouldn't work on him. If he can punch her like that, surely she has some leeway to react back in her own way.
What is "funny" is that with Texas' Stand Your Ground laws, if she'd pulled out a gun and shot him dead, she'd go scott free without any record. But she threw something through his car window, so she's a felon.

He must be afraid of something if he felt a need to change his nasty appearance A.S.A.P. Maybe hoping people who saw the video won't recognize him on the street? I hope they will see his new incarnation clearly.
