McConnell: 'I would have no choice but to take it up' if House votes to impeach Trump
Source: CNBC
The Senate would have to take up impeachment of President Donald Trump if the House effectively votes to charge the president, Senate Majority Leader Mitch McConnell said Monday.
I would have no choice but to take it up, the Kentucky Republican told CNBC. How long you are on it is a different matter, but I would have no choice but to take it up based on a Senate rule on impeachment.
House Speaker Nancy Pelosi on Tuesday announced the start of an impeachment inquiry into Trump amid scrutiny over whether he tried to influence the 2020 election by urging Ukraines president to investigate the family of Joe Biden, the former vice president and one of his chief rivals for the presidency. The House Intelligence Committees investigation could lead to a full chamber vote to impeach the president.
If the House impeaches, the Republican-held Senate would then hold a trial on whether to convict Trump and remove him from office. Despite the current lack of support for the inquiry among Senate Republicans, McConnell said the chamber by rule would have no choice but to follow through with the process.

(42,698 posts)There is/was no rule that requires the Senate to act on Garlands nomination (or any nomination for that matter)

(70,491 posts)Article II, Section 2, Clause 2 of the United States Constitution
Article II, Section 2, Clause 2:
He shall have Power, by and with the Advice and Consent of the Senate, to make Treaties, provided two thirds of the Senators present concur; and he shall nominate, and by and with the Advice and Consent of the Senate, shall appoint Ambassadors, other public Ministers and Consuls, Judges of the supreme Court, and all other Officers of the United States, whose Appointments are not herein otherwise provided for, and which shall be established by Law: but the Congress may by Law vest the Appointment of such inferior Officers, as they think proper, in the President alone, in the Courts of Law, or in the Heads of Departments.
So I take it you believe that the Senate violated the Constitution every single time it failed to take action on a proposed treaty, ambassadorial nomination, district court judge, appeals court judge, cabinet member, subcabinet member...
There are more examples of that happening than can be counted.
Nothing in that provision of the Constitution requires the Senate to consent to a presidential nomination. And it doesn't compel the Senate to reject a nomination by voting it down as opposed to sitting on it (as often is done).

I just cannot imagine how people in the state support a person that got money from a-hole Russian that helped in the electioneering, and still runs around thinking that it is just fine and dandy for a foreign power to take there votes away.........................that is reprehensible.

(8,677 posts)The Dems need to expect something like that and be prepared to counter it somehow. Perhaps have multiple impeachment votes on multiple issues.
