N.J. seeks to revoke liquor license for one of Trump's golf clubs

The state of New Jersey is seeking to revoke the liquor license for one of President Trumps golf clubs a rare and potentially damaging punishment, triggered by a 2015 case where the Trump club allegedly over-served alcohol to a man who then caused a fatal wreck. That proposed punishment was laid out in an Oct. 21 letter to the Trump golf course in Colts Neck, N.J. The Washington Post obtained the letter through a public-records request.
The office of New Jersey Attorney General Gurbir Grewal, which sent the letter, declined to comment about the letter. Grewal was appointed in 2018 by Gov. Phil Murphy (D). The letter gives few details about the alleged misconduct by Trumps course. The man that the club is accused of over-serving Andrew G. Halder caused a wreck that killed his own father and last year pleaded guilty to vehicular homicide. Trumps company was given 30 days to challenge the planned revocation.
If the states Division of Alcoholic Beverage Control does decide to revoke the license, Trump can challenge that decision in court or try to get it reinstated in two years. The Trump Organization did not respond to a request for comment on Thursday. If the clubs liquor license is revoked, that would be a blow for the Colts Neck course, located near the Jersey Shore. The club could lose significant revenue from the two restaurants and a bar it operates for members, and find it hard to attract banquets or golf tournaments from outsiders.
But for Trump, the potential damage is greater than that. Under New Jersey law, anyone who has one liquor license revoked must also give up all their other liquor licenses for two years. Trump has two other New Jersey golf clubs, including the one in Bedminster, N.J., that he uses as a summer White House. Now, he could be faced with losing a key source of revenue at those clubs, too.

(129,360 posts)and if he so claims to be "divested" or whatever, then there's nothing he can do about it but have the organization go through their state commission appeal process and/or the state courts. If what the state of NJ would be doing is not in violation of the U.S. Constitution, then a federal court would laugh in their faces and wouldn't even bother to hear it.

(129,360 posts)in FL was not just a "state issue" because there would be an impact on the Electoral College, which is something that is covered in the U.S. Constitution (along with other Constitutional issues related to how the state law was being applied). I.e., Shrub and FL (thanks to Jeb) found all kinds of loopholes to invoke based on their state laws and state Constitution.
In this case in New Jersey, the granting or withholding of liquor licenses is not something the SCOTUS might want to set a precedent for considering the number of "states rights" members on there. If Drumpf can show that other facilities are not treated the same for similar violations, then they might be to argue the "Equal Protection" clause. But the state board revokes licenses for all types of things including for facilities acting as illegal drug storage and peddling or for illegal cockfighting.
The state law is pretty fascinating though and there are all kinds of things that can prompt a revocation -

And there is a process that establishments would normally follow to appeal with the board, so blowing that process off only makes it worse. Basically, regardless of the outcome, this will cost money in legal fees to adjudicate.
Of course here in neighboring PA, we are way worse because we have a dwindling few "Blue Laws" still left on the books although those are slowly being chipped away (but people often head over the bridge to Jersey to purchase).

He now has 29 or 28 days (depending on when they sent the notice) to respond if they choose to appeal the board's conclusion.
