Trump's Florida voter registration trips up his Mar-a-Lago plans

Source: raw story

Published 5 hours ago on May 17, 2020

Amid all the intensity and serious of pandemic, this little fable with no international significance has been percolating over in a quiet corner of our world.

Once upon a time, a couple of months ago, Donald Trump moved his formal residence – and voting address – from the gilded Trump Tower in New York City to the equally exclusive Mar-a-Lago in Palm Beach. But, in doing so, he stubbed his toe on local regulations that now are keeping him from adding a dock to his property.

Maybe he plans to move from golf to boating. More likely, he wanted to serve his high-flying friends and visitors at Mar-a-Lago by providing a waterside mooring.

Now, Trump has ended up withdrawing his dock request after The Washington Post disclosed that there was a local law requiring that only residential owners are eligible for docks in the interior south Florida waterways..................................

.............Reginald Stambaugh, an attorney who represents one of Mar-a-Lago’s neighbors, said he is hopeful that the president will now permanently drop the dock proposal.

“One prevalent issue remains lingering, whether President Trump still considers Mar-a-Lago Club his residence,” Stambaugh said Tuesday. “He still can’t have it both ways. It’s either a club or a residence — not both. Florida’s voting laws apply to citizen Trump. If he resides there, he will have to close the club.”.........................

..............Attorneys and historical preservationists in South Florida immediately began digging into town records, unearthing an agreement that Trump made in 1993 to convert Mar-a-Lago from a single-family residence to a private club owned by a corporation Trump controls. The agreement includes a provision that bans members from using the club’s guest rooms for longer than seven days at a time three times a year. Trump’s attorney at the time, Paul Rampell, assured council members that he would not live at the club.

The agreement also banned construction of a dock, but Trump was asking for that condition to be waived. Trump’s attorney originally argued that the dock was necessary for the president’s protection. That claim was included in an application that made no mention of Mar-a-Lago being the president’s home. In a later application, the rationale was changed, with Trump asserting that the club is his “personal residence.”................................................

“You voted by mail in Florida’s election last month, didn’t you?” the reporter asked.

“Sure,” the president replied. “I can vote by mail.”

To register in Florida you must:

* be a legal resident of both the State of Florida and of the county in which you seek to be registered

https://www.vote.org/voter-registration-rules

104.011 False swearing; submission of false voter registration information; prosecution prohibited.—

(1) A person who willfully swears or affirms falsely to any oath or affirmation, or willfully procures another person to swear or affirm falsely to an oath or affirmation, in connection with or arising out of voting or elections commits a felony of the third degree, punishable as provided in s. 775.082, s. 775.083, or s. 775.084.
(2) A person who willfully submits any false voter registration information commits a felony of the third degree, punishable as provided in s. 775.082 or s. 775.083.
(3) A person may not be charged or convicted for a violation of this section for affirming that he or she has not been convicted of a felony or that, if convicted, he or she has had voting rights restored, if such violation is alleged to have occurred on or after January 8, 2019, but before July 1, 2019.

Of course, given that Trump is -- according to his legal team -- completely immune from prosecution while serving as president, I guess this means he can register to vote in all 50 states if he feels like it. Hey, he could probably vote like 50 million times in each state if he wanted to. Remember -- when the president does it, it's not a crime!

Assuming he is not a legal resident per the standards quoted, he would not be able to register to vote there. If he isn't registered to vote in Florida, he would not be sent an absentee ballot.

On the Other Hand, if he is still registered to vote in NY he could have voted absentee in NY State.

I wonder if Donnie wants a dock so he’ll have the option of fleeing the country by boat in case the arrest warrants go out. Fewer questions asked than if he tries to flee by airplane.

(Of course they wouldn’t welcome him in Cuba if he tried to flee south)

Not only that, they can get inspectors, bylaw officers and so on to "miss" obvious violations.

people of PB really don't like Trump. He's "overly everything." They like quiet and subtle, never ever discuss money except where or when appropriate. Shortly after he bought MAL he thought he would like a huge, and I mean huge American flag in front of the place. Town Fathers said no, too big and ostentatious. The donald was not happy and I believe took them to court. Of course he lost. If he thinks he's going to grease some palms in PB, not going to happen. They laugh at him behind his back.

Staff who live there?

Then, if it's like Texas, he can legally vote there. In Texas, you aren't supposed to register at a business address. However people do it all the time and nothing happens. However, even if caught, the worst thing they do will just unregister you.

We have a few people that get caught when they use a business address (a post office address, gas station, vacant lot or junkyard etc) when they file for office. They literally commit fraud just to get into a jurisdiction where they feel they can win etc.

If, under Florida law, Mar-o-lago can't be both a club and a residence. So then how can he use Mar-o-lago as his voting residence?
