23 GOP Attorneys General Threaten to Sue Biden Over 'Disastrous' COVID Vaccine Mandate

In a letter to President Joe Biden, two dozen of the nation's Republican attorneys general said Thursday they would seek legal action if the White House's proposal to require vaccines for 100 million Americans is carried out.

The GOP prosecutors chastised Biden for the proposed measure, which would see a federal vaccine requirement imposed for private-sector employees, health care workers and federal contractors. The requirement, announced earlier this month, is being enacted through a rule from the Occupational Safety and Health Administration (OSHA) as part of an effort to inoculate Americans from the more deadly delta variant.

"Your plan is disastrous and counterproductive," the prosecutors, led by Attorney General Alan Wilson of South Carolina, wrote in a letter sent to Biden. "If your Administration does not alter its course, the undersigned state Attorneys General will seek every available legal option to hold you accountable and uphold the rule of law."

The OSHA rule, which covers nearly two-thirds of the private sector workforce, would last six months, after which it must be replaced by a permanent measure. Employers that don't comply could face penalties of up to $13,600 per violation.

'Disastrous' is what the GOP is these days. Many the states suing already have mandatory vaccination laws for other diseases.

Jacobson v. Massachusetts, 197 U.S. 11 (1905), was a United States Supreme Court case in which the Court upheld the authority of states to enforce compulsory vaccination laws. The Court's decision articulated the view that individual liberty is not absolute and is subject to the police power of the state.

The issues that will be raised in challenges to the OSHA order will be whether (a) OSHA has statutory authority to impose a mandate and (b) whether the Constitution confers authority on the federal government to impose a nationwide vaccine mandate.

Don't rule out the possibility that a Trump-stacked court will find a way to distinguish Jacobson.

GOP doesn't know how to govern, they are constantly looking for ways to screw the country, how so many people cannot see this is beyond comprehension. That is the only thing they do all day, how can they cheat in elections, how can they destroy the freedom of people, how can they put money in their banks, how can they hurt people...The title of the book "It is all about the cruelty" is spot on.

There is no criminal penalty, no fine, no jail time, for those that opt out.

A person may be restricted from entering certain areas where others are at risk of exposure if they do not have the shot, or, alternatively, have a test showing they are clear of the virus.

This is a policy supported by a large majority of Americans, it is within the bounds of previous policies, and it is justified by the deaths of hundreds of thousands Americans.

If the Republican wingnuts want a huge public battle over this, then they are qrazy.

Key to the defense would be death rates where the policy is implemented compared to death rates where the policy is ignored.

Make them explain why they want list to grow bigger. What's in it for them? Has the governor been personally written letters of condolence to the families of each of these victims?
