Federal judge rules Texas schools can issue mask mandates.

A federal judge ruled on Wednesday that Gov. Greg Abbott’s ban on mask mandates in Texas schools violates the rights of students with disabilities, clearing the path for districts in the state to issue their own rules for face coverings, a decision that could affect more than 5 million students. The ruling comes after months of politicized disputes over measures to prevent the spread of Covid that had pitted many parents of students with disabilities against the governor and other state officials who maintained that protecting against the virus was a matter of personal responsibility.

Judge Lee Yeakel of U.S. District Court for the Western District of Texas made the ruling. Siding with the parents and the organization Disability Rights Texas, Judge Yeakel ruled that the order from the governor violated the 1990 law because it put children with disabilities at risk. Judge Yeakel’s ruling also prohibited the attorney general of Texas, Ken Paxton, from enforcing the order by Mr. Abbott, who has repeatedly opposed Covid-related mandates.

“The spread of COVID-19 poses an even greater risk for children with special health needs,” Judge Yeakel said. “Children with certain underlying conditions who contract Covid-19 are more likely to experience severe acute biological effects and to require admission to a hospital and the hospital’s intensive-care unit.” The State Supreme Court has repeatedly sided with the governor by allowing his ban to remain in effect.

But the impact of Wednesday’s ruling could ripple across the country as other Republican-controlled states seek to rid their schools of Covid mandates through the courts. The offices of Mr. Abbott and Mr. Paxton did not immediately respond to requests for comment on Wednesday night.

This will get appealed no doubt, all the way up to the SCOTUS. In this case, they do have a fallback of the ADA as a justification to remove the ban.

His sister lives in my town. Lovely woman. She has told me her brother was a good guy even though conservative. Now I see she may be right. He's restrained Paxton from enforcing Abbott's ban. Good move.

Of course it will be appealed, but it's a strong decision and may well hold up in other areas.

Well isn't that fucking marvelous. In other words, "we don't care how fast the pandemic spreads through schools, because the big issue is that the Acting Secretary didn't sufficiently kiss the collective ass of PA's Trump-fluffing legislature."

Whenever this case gets to the state Supreme Court, it will hit a 5 (D) - 2 (R) majority.

The GOP is attempting to void everything Wolf has done with respect to "emergency declarations", where general disaster/emergency declarations are declared by a Governor, and they were able to get the state Constitution changed to limit the time length of any gubernatorial declarations, which would now be subject to state legislature approval for extensions.

However PA's Health laws have NOT been suddenly "repealed" when they did that gubernatorial authority change and the state Public Health laws are what drives the masking / vaccination mandates (and are NOT done "by the governor", but by the state's Health Director, who is appointed by the governor).

It's their convoluted bullshit way to get around the Public Health laws by suddenly declaring that a "Public Health Emergency" is somehow the same as other "emergencies/disasters", despite the fact that there are different authorities assigned for each type of "emergency" in state law.
