Manchin to vote to nix Biden's vaccine mandate for larger businesses

Sen. Joe Manchin (D-W.Va.) said on Thursday night that he is supporting a GOP effort to nix President Biden’s vaccine mandate for larger businesses, which is expected to get a vote in the Senate next week.

“Let me be clear, I do not support any government vaccine mandate on private businesses. That’s why I have cosponsored and will strongly support a bill to overturn the federal government vaccine mandate for private businesses," Manchin said in a statement.

Because all 50 Republicans are supporting the effort, Manchin's vote gives Senate Republicans enough support to pass a resolution to nix Biden's vaccine mandate for larger employers. The resolution would still need to pass the House and, even then, would likely be vetoed by Biden.

Republican senators introduced the resolution earlier this year under the Congressional Review Act (CRA) to roll back the mandate, with which the Occupational Safety and Health Administration (OSHA) orders businesses with at least 100 employees to require their workers to get vaccinated or undergo regular testing by Jan. 4.

CRA, which is a tool that Congress can use to repeal Rules published by government agencies. The Act requires each chamber to draft legislation of disapproval of the Rule (within a fixed timeframe from when the Rule was published) and then vote on that. If that passes Congress, then the President can sign or veto. This whole process is a carve-out from the 60-vote Cloture rule in the Senate.

So basically, this is going nowhere because even if the Senate passes their version with Manchin, the House won't pass theirs, and even by some freak circumstance results in them passing it, then Biden would obviously veto it and they don't have enough to override.

This whole production seems to have been a compromise to move the C.R. before a shutdown because there were threats by the GOP to block it unless they could amend it with this nonsense. Thus a vote for the "standalone" bill to get rid of DOL's vaccine Rule.

As a note, Democrats have been using the CRA to reverse all the bullshit put in place by 45. The below-linked site has a good tracker on the revocation process of Rules implemented by the previous administration -

on final passage (that blocked nothing) to a higher impact and/or meaningful level than the actual blocking (Manchin forcing Biden to withdraw Neera Tanden's nomination for OMB head for instance), ripping apart apart and massive gutting that Manchin and Sinema have done to Biden's agenda pre final vote.

He's only in favor of "big government" when it benefits his Republican donors. As for the rest of us ... Who needs child care, or universal pre-K, anyway? Or clean energy? Or increasing Medicaid to cover more Americans?

Anyone want to bet he runs as a Republican in 2024? Or switches his party in in 2022 if the Rs win the Senate?

the employer mandate is in the courts which gives me no comfort. Doctors or some intelligent organization should push for boycotts of companies who defy the vaccine mandate. I personally would avoid such companies if possible.

Companies don't want active employees to get sick and be absent from work and/or spreading the virus to other employees.

Companies that provide health insurance, don't want their part of the premium to go up because of an increase number of their employees needing medical care due to covid.

Companies that deal with the public on a daily basis don't want to be accused of spreading the virus to their customers, or their customers to stop doing business with them.

There is a economic incentive to require employees to either be vaccinated or constantly tested.
