The move by the attorney general, Letitia James, comes at a critical moment in a criminal inquiry into the former president, who could try to block the demand.
The New York State attorney general, Letitia James, is seeking to question former President Donald J. Trump under oath in a civil fraud investigation, according to two people with knowledge of the matter, an unusual move that comes at a critical juncture in a parallel criminal investigation into the former president.
Ms. James, whose office is also participating in the criminal investigation being run by the Manhattan district attorney, Cyrus R. Vance Jr., is seeking to question Mr. Trump on Jan. 7 as part of her separate civil inquiry into his business practices.
Civil inquiries cannot lead to criminal charges. If Ms. James finds evidence of wrongdoing, she could file a lawsuit against Mr. Trump.
But her request comes as Mr. Vance is pushing to determine whether Mr. Trump or his family business, the Trump Organization, engaged in a pattern of criminal fraud by intentionally submitting false property values to potential lenders. Mr. Vance, a Democrat, did not seek re-election and is leaving office at the end of the year.

(7,433 posts)Trump has bought everyone off. He's bought off the NY AG's office, the entire DOJ, the Fulton County AG, and anyone else who has the power to force accountability. Watch what happens with the NY deposition. Trump will find a way to delay and obfuscate, and he'll have at least some success in holding off the deposition until...well, November of 2022.
I know. This perverted fantasy will be proven abundantly false. But sometimes a story can be constructed from what is NOT SAID or done. The DOJ's reluctance to move aggressively against the 1/6 insurrection organizers and coordinators shows "reluctance" on a massive scale. So what is to be surmised by this slow-walking and dismissiveness? Where are the other grand juries? Does the DOJ have a grand jury that is looking at evidence of Trump's CONSPIRACY to overthrow the election and the entire US government? How would we ever know?
So? Says I.

See the difference between what the select committee is doing and what AG's and DA's can do? This is why I keep harping that DOJ has to get involved in the insurrection, it has more clout.

So while it will "incriminate" him in the eyes of some, it cannot be held against him in a court of law. It is still up to the prosecution to prove their case.

(838 posts)Certainly not holding my breath. He'll die long before this gets untangled in the courts. His litigation is legion; TFG will never see the inside of anything resembling a detention area.
Best we can hope for is some of this shit to splatter on his offspring.
