Trump lawyers: Judge abused discretion in forcing testimony

NEW YORK (AP) — Donald Trump’s lawyers say a New York judge abused his discretion with a decision last month requiring the former president to answer questions under oath in a civil investigation into his business practices.

In papers filed Monday in a state appeals court, Trump’s lawyers said Manhattan Judge Arthur Engoron failed to properly weigh constitutional and ethical concerns that they’d raised about New York Attorney General Letitia James’ investigation.

Lawyers for Trump and his two eldest children, Ivanka and Donald Trump Jr., want the appellate division of the state’s trial court to overturn Engoron’s Feb. 17 ruling and invalidate James’ subpoenas seeking their testimony.

They detailed their arguments in a 72-page joint brief Monday, rehashing prior claims that James, a Democrat, had a political vendetta against Trump, a Republican, and that forcing the Trumps to testify would violate their constitutional rights because answers could be used against them in a parallel criminal investigation.

I wish if Alvin Bragg isn't going to prosecute Trump he would fucking drop the case seeing as Trump is using the criminal case as an excuse to not testify in the civil case.

Listened to Thom Hartmann today, when Reagan was president we had 1 billionaire in America, now we have 400. Democracy can only succeed if we tax the rich otherwise they buy the politicians, buy the media, buy the judges, fund Trump.

Its 100% correct, none of these cases will ever go anywhere. Gaetz is not going to be charged, Trump will skate by with maybe some fines for his business.

It is what it is, inflation and crime will decide the midterms. A Trumpy Repug will get the nomination in 2024 and it will come down to PA, MI, WI again.

They get paid from the donations he still rakes in. Trump has plenty of money for lawyers. Suppliers and vendors may have to fight for their money but he will pay his lawyers. Rudi did not get paid because Trump thought he was a bozo, was done with him, and knows Rudi has no way to fight back and get paid. But Trump pays his real lawyers, they have been how he conducts business from day 1. In fact, his top lawyers will get paid first before anyone else. They are his top priority.

CNN and other outlets have reported that lead attorney Butch Bowers and four other lawyers he assembled for the team walked out over a disagreement about the ex-president's defense strategy but Axios reports that the team split following a blow-up with the "notoriously stingy" onetime reality TV host over legal fees. Trump, who is charged with inciting the deadly Jan. 6 Capitol riot, was "livid" after Bowers told him that the legal effort would cost $3 million, according to the report, even though Trump has raised over $170 million from supporters, ostensibly to fund his post-election legal efforts.

Trump and Bowers initially agreed that the latter would be paid $250,000, which "delighted" the billionaire, according to the report. But that fee did not include additional costs for other lawyers, researchers and legal fees. Trump was "infuriated" after Bowers told him the total budget would be $3 million, though he ultimately haggled the attorney down to $1 million while planning to use his political action committee to pay for "audiovisuals, a rapid-response team and legislative liaison."

Gaetz nor Trump are ever going to be charged. That is just the way the system works. At the very most the Trump organization will pay some fines for inflating the assets and go on about their business.

The case will never be resolved.
They can come up with more and more frivolous complaints and each one has to be litigated one at a time.
Everyone involved with Trump Inc will be dead before the case can come to trial.

There should be some mechanism to stop this but there isn't.

Judicial discretion is judicial independence.

Fighting subpoenas at the level of politicizing judges is the politicizer's way. They might as well be Putin calling the judge a Nazi. It's the ongoing Koch-Thiel-Trump networks' war of attrition against court systems and public interests. They'll stall and lose, because when it comes to loss, harm or damage suits, the interests of orgs and individuals can't prevail over interests of the overall state public.
