Cawthorn tells McCarthy orgy, cocaine remarks were exaggerated

Rep. Madison Cawthorn (R-N.C.) admitted suggestions that his colleagues have done cocaine and invited him to orgies were "exaggerated" in a tense meeting with Rep. Kevin McCarthy (R-Calif.), the House GOP leader told Axios.

Driving the news: McCarthy says he may take further action to condemn Cawthorn over his "unacceptable" remarks, which set off a firestorm within the House Republican conference.

What he's saying: "There's a lot of different things that can happen," McCarthy told Axios and other reporters.

"I just told him he's lost my trust, he's gonna have to earn it back, and I laid out everything I find is unbecoming. And, you can't just say 'You can't do this again.' I mean, he's, he's got a lot of members very upset."

18 U.S. Code § 4 - Misprision of felony
Whoever, having knowledge of the actual commission of a felony cognizable by a court of the United States, conceals and does not as soon as possible make known the same to some judge or other person in civil or military authority under the United States, shall be fined under this title or imprisoned not more than three years, or both.


Albeit, they failed to report different crimes.

“[A] person who witnesses a crime does not violate 18 U.S.C. § 4 if he simply remains silent.” United States v. Ciambrone, 750 F.2d 1416, 1418 (9th Cir. 1984)

See also Neal v. United States, 102 F.2d 643, 646 (8th Cir. 1939):

`To sustain a conviction * * * for misprision of felony it was incumbent upon the government to prove beyond a reasonable doubt (1) that * * * the principal, had committed and completed the felony alleged * * *; (2) that the defendant had full knowledge of that fact; (3) that he failed to notify the authorities; and (4) that he took * * * affirmative steps to conceal the crime of the principal.'

Typical acts of concealment include making false statements to law enforcement authorities, hiding evidence, and harboring the felon.

You can’t “conceal” a crime that you learned about because the criminal was running his mouth off about it about on national television.

What a bunch of hypocrites...and if they are that upset something tells me that maybe Cawthorn is telling the truth???

How dare Cawthorn spill the beans that way...Well, that is it, we will not invite him again to our orgies and cocaine tastings.

It is a very lawyerly way of saying he didn't repeat his exact words.

Exaggerated? So what parts were true? Was it just a small bump of coke and not a huge one? Were some of the members younger or older than 60-70's?

It's a non-denial denial.

Basically, he is upset he said it publicly. He is not saying it categorically untrue.

thinking all the Democrats would vote for that, so he would just need enough republicans to make the two-thirds majority, all the Democrats should vote to keep him. He's doing us far more good than he is for the republicans.
