Johnson & Johnson ordered to pay $302M in pelvic mesh case

SAN DIEGO (AP) — A California appeals court has upheld a lower court ruling that Johnson & Johnson must pay penalties to the state for deceptively marketing pelvic mesh implants for women, but reduced the amount by $42 million to $302 million.

Johnson & Johnson had appealed in 2020 after Superior Court Judge Eddie Sturgeon assessed the $344 million in penalties against Johnson & Johnson subsidiary Ethicon.

Sturgeon found after a non-jury trial that the company made misleading and potentially harmful statements in hundreds of thousands of advertisements and instructional brochures for nearly two decades.

California’s Fourth District Court of Appeal issued a ruling Monday that $42 million in penalties assessed for the company’s sales pitches to doctors were unjustified because there was no evidence of what the sales representatives actually said.

But let's put this in perspective, shall we? This a penalty levied by CA. In addition, J & J and others have paid around 60,000 women ~$8 billion to compensate the millions of women affected by this product. The average settlement, apparently, was around $12K, but after legal fees, it is whittled down to around $3,500. This means that, of the $8 billion, $5.66 billion (71%) was consumed by LEGAL FEES, and the victims who live in constant pain with permanently affected health only got 29% of the money that this company and others paid out in settlements.

Now let's look at Johnson and Johnson: It's net worth is reputed to be $70.4 BILLION, and in just the 4th quarter of 2021, J & J's profits were up 272% from the same quarter in 2020 - a whopping $4.74 BILLION dollars. IN ONE QUARTER.

And, of course, we cannot forget that CEO Alex Gorsky 'earned' $23,139,974 in total compensation. Of this total $1,650,000 was received as a salary, $3,148,515 was received as a bonus, $4,382,995 was received in stock options, $13,757,654 was awarded as stock and $200,810 came from other types of compensation.

TRICKLE DOWN. This is what TRICKLE DOWN looks like here in this capitalist utopia that is 'Murika, where we hold profits to be FAR more important than people.
