A federal judge opens the way for a dramatic showdown to determine the future of the Republican congresswoman who has supported the Jan. 6 insurrectionists.

In a major blow, Rep. Marjorie Taylor Greene (R-Ga.) lost a bid Monday to block a constitutional challenge to her reelection over her support for last years U.S. Capitol riot.
U.S. District Judge Amy Totenberg of the Northern District of Georgia denied Greenes request for a preliminary injunction and temporary restraining order in the dramatic legal battle.
That means a group of Georgia voters and the nonpartisan voters rights organization Free Speech for People can presents their arguments in court that Greene should not be allowed to run for reelection because of the so-called insurrection disqualification clause of the 14th Amendment.
Section 3 of the 14th Amendment bars lawmakers who, after previously taking an oath to support the Constitution, then engaged in insurrection or rebellion against the same or gave aid or comfort to the enemies. The section was added after the Civil War to prohibit lawmakers from representing a government they had wanted to toppled.
Greene repeatedly refers to the Jan. 6, 2021, insurrectionists as patriots and has called those arrested over the attack on the Capitol political prisoners. She has been recorded on video announcing her opposition to the peaceful transition of power to Joe Biden after Donald Trump lost the 2020 presidential election.

(43,258 posts)How it makes it through Federal courts with Trump appointees and through SCOTUS would be quite a story. Trouble is it is so very clear, it just doesn't prescribe any enforcement mechanism. Presumably the courts would be the place to seek remedy.
Fingers crossed. One successful suit leads to dozens of others. Dozens.

(37,452 posts)it wasn't for sometime after that those involved were able to reclaim position in government, after an oath of allegiance and clemency . See reconstruction acts. I think the key to upsetting her apple cart is the confederate state had to agree to the provisions of the 14 amendment, which included this subsection. Former Confederate states did not get congressional representation until they adopted this amendment.

And it was interesting, because I could see how upset she was without having to hear a word. She is fit to be tied. If she gets any angrier, she'll go right through the floor like Rumplestiltskin!
I sure hope this effort to block her from running again works. In the meantime, we can all sit back and savor the schadenfreude. 😁
