U.S. Chief Justice Roberts calls abortion draft leak 'appalling'

ATLANTA (Reuters) - U.S. Chief Justice John Roberts on Thursday decried as "absolutely appalling" the leak of a draft decision indicating the Supreme Court is poised to overturn the constitutional right to abortion in his first public appearance since its disclosure on Monday.
The leak prompted an internal crisis at the nation's top judicial body and ignited a political firestorm, with abortion rights supporters staging rallies outside the courthouse and at various locations around the United States.
"A leak of this stature is absolutely appalling," Roberts told a judicial conference in Atlanta.
"If the person behind it thinks that it will affect our work, that's just foolish," Roberts added.

What's appalling is trying to base one's decision on the argument of a 17th century English barrister who had women executed for being witches.

I've read it, and the "logic" is flawed, to say the least and some of the legal underpinnings? relying on quotes from an English judge from the 17th century who sentenced women to death for witchcraft? (7,403 posts)Roberts should be more concerned that he has lost control of the Supreme Court. He should also be concerned by the implication of this decision beyond Roe and Casey.
There is a reason for Stare Decisis, and this case encapsulates them all. Even with Stare Decisis there has been a "sliding scale" applied. This decision not only removes Roe and Casey but also removes this sliding scale and calls into question a broad range of decisions within this sliding scale. Examples include Brown v. Board of Education (racial discrimination), Roe v. Wade (reproductive rights), Bush v. Gore (election recounts), Reed v. Reed (gender discrimination), and University of California v. Bakke (racial quotas in education). This decision creates uncertainty with each of these decisions and whether they fit under the new standard. These decisions have occurred both before Roe and after Casey and this draft copy does not consider any of these concerns. And it reads like it was written by about a 10th grader.
