After the FBI found highly classified documents inside his Mar-a-Lago home, former President Donald Trump sought review of the materials by a special master. Now that his choice for that position has been appointed, Trump's attorneys struggled in their efforts to have the review process play out in the way they prefer.
On Tuesday, a skeptical Senior U.S. District Judge Raymond Dearie pressed Trump's lawyers repeatedly on their refusal to disclose whether he declassified any of the documents he brought to Mar-a-Lago -- and if so, which ones.
"The government gives me prima facie evidence that these are classified documents," Dearie said, referring to the plain markings on the records. "As far as I'm concerned, that's the end of it."
Dearie gave Trump's lawyer James Trusty ample opportunity to explain why his consideration shouldn't end there.

Judge Raymond Dearie pushed Trumps lawyers repeatedly for refusing to back up the former presidents claim that he declassified the highly sensitive national security-related records discovered in his residence.
You cant have your cake and eat it too, said Dearie, the special master picked by U.S. District Court Judge Aileen Cannon to vet Trumps effort to reclaim the materials taken by federal investigators.
Trump has argued that the 11,000 documents taken from Mar-a-Lago were rightfully in his possession, including about 100 bearing classification markings that suggest they contain some of the nations most closely guarded intelligence.

Why any lawyer would work for Trump is a mystery now since association with him now marks one as a corrupt attorney. I seem to remember reading somewhere a few weeks ago that some Trump administration lawyers and aides were having a tough time finding new jobs. I suppose the Federalist Society cant hire all of them.

She is so obviously pro T****. She set it up so she has absolute control over the outcome. Right away, they challenged Dearie and are seeking to control the timeline. I don't think they expected Dearie to be so swift.
I think we may have a problem, but it sure won't look good if she immediately replaces Dearie with T****'s other candidate, without considering the Government's candidates.

I'm going to bet somebody has already spoken truth to her -"You tried to spin this for Trump, and it backfired, because you made your reasons out of nothing. You are already on very thin ice, and you better do something to save yourself. And dumping Dearie, or negating his findings, will make it even worse for you."

The fact that he is a deposed dictator and now just another private citizen seems to escape some slower thinking individuals in the population.

2. I never agreed to the Presidential Records Act, so it doesnt apply to me. Any and all records created during my time in the White House are my own personal records.

(6,562 posts)that, since Dearie gave T****'s attorneys chances to provide the info he asked them for, which they declined to do, and since he said, "As far as I'm concerned that's the end of it," that T**** is now saddled with the fact that he had control of classified docs. !!! I don't know if they can run back to Cannon and file for relief on that. I'm not sure how the SM decision reflects back up to the 11th Circuit, but can't the Government now point to the SM decision as supporting their claim?
We won this day, for sure. I think it was a mistake for "T****'s Team" to defy the SM. I think it is possible that now they will belatedly provide some stupid argument for declassification, but it seems like Dearie doesn't plan to revisit the issue. And I like the way he characterized the docs as "prima facie evidence." I believe that shifts the burden onto T****, and apparently they have nothing. I guess they could contrive an artificial delaying argument to waste time, and that they don't care how stupid they look. $3 million bucks, baby...

The Mar-a-Lago special master on Thursday ordered Donald Trumps lawyers to state in a court filing whether they believe FBI agents lied about documents seized from the former presidents Florida residence in a court-authorized search last month, or claimed to have taken items that were not actually in Trumps possession.
Dearie also told them to say whether they are claiming that any items on the inventory list were not in fact taken from the premises.
Trump has said on social media and in television interviews that the FBI planted items when they searched his Mar-a-Lago residence and private club on Aug. 8. He also claimed to have declassified documents found in that search that were marked classified and were highly sensitive. His lawyers have not made similar assertions in court, however, instead saying they have not reviewed the seized materials and are unable to confirm whether the governments inventory list is accurate.
Dearies order, in essence, demands that Trumps lawyers back up their clients claims. This submission shall be Plaintiffs final opportunity to raise any factual dispute as to the completeness and accuracy of the Detailed Property Inventory, he wrote.
At a hearing Tuesday, Dearie pressed Trumps lawyers to take a position on whether the classified documents were, as Trump has said, declassified, but they demurred.
