Texas sheriff certifies the Martha's Vineyard migrants are crime victims, open the door for spec visa

Source: wgbh

A Texas sheriff has certified that the nearly 50 migrants flown to Martha’s Vineyard by Florida Gov. Ron DeSantis were victims of a crime. That certification is a key step in qualifying them for a special visa they would not have otherwise been eligible for.

What a great guy that De Santis is! Willing to spend over a $100,000 of state covid funds per migrant to get them citizenship!

Compared to the normal immigration process, which I went through with my wife, this makes it easier for them to become a lawful permanent resident.

IIRC, the family also qualifies for special visas and green cards.

This what I learned at a labor trafficking and human trafficking seminar in 2019 while I volunteered for an organization that may have clients who are victims.

I generally lean toward open immigration policies, the current “process” is cruel and absurd.

Would it be a felony conviction either for misappropriation of federal funds or for transporting migrants under false pretenses?

In other states the person has to petition the govt to have their voting rights restored.

But I think in most (maybe all?) states a convicted felon can't vote while they're serving their sentence. I'm not an expert on that though.

These are asylum seekers who are here "legally", but their status is temporary until they have been granted asylum. (Legally in that they have been processed by ICE and are now free to travel, however, they are required to attend their scheduled asylum hearings. At the hearings they will then determine whether asylum should be granted. The process can take a long time.)

The crime would have been that they were taken to a different place than they had been promised.

Keep in mind, this isn't as much criminality of DeSantis as it is of their rights because a crime had been committed.

In this case, the crook is Perla Huerta. (Local crime. He is the sheriff, he's not the FBI or a federal prosecutor or a prosecutor)

Being able to prosecute and being offered a special Visa because one is a victim of a crime are two separate issues. Apparently, the laws allow law enforcement to indicate if someone is a victim of a crime. However, no one has been charged, not locally or federally.
