In Documents Review, Special Master Tells Trump Team to Back Up Privilege Claims
Source: New York Times
WASHINGTON The special master reviewing materials seized by the F.B.I. from former President Donald J. Trumps compound in Florida expressed skepticism on Tuesday about early claims by Mr. Trumps lawyers that certain documents were privileged and thus could be withheld from a Justice Department investigation.
In a phone conference, the special master, Judge Raymond J. Dearie of Federal District Court in Brooklyn, complained that the log of an initial batch of documents over which Mr. Trump is seeking to claim privilege lacked sufficient information to determine whether the arguments were valid.
Judge Dearie encouraged Mr. Trumps lawyers to give him a better sense of why they believed the documents could be lawfully shielded from the Justice Departments inquiry into whether Mr. Trump unlawfully kept classified records at his estate and obstructed the governments repeated efforts to retrieve them.
Its a little perplexing as I go through the log, Judge Dearie said. Whats the expression Wheres the beef? I need some beef.

OK, that's not an actual quote; but it is in the spirit of her rulings.

(23,105 posts)3. Wonder when she'll pull everything back from the Special Master and do "her own" review?
I think that was included in the original order, that she could pull it back. She's the worst of the worst.

(27,597 posts)6. 11th Circuit appeal timeline
Just a reminder:
Under the schedule set by the court, federal prosecutors must file their initial brief by Oct. 14, and Trump's team has until Nov. 10 to submit its response. If the Justice Department wishes to reply, it has until Nov. 17 to do so. No extensions will be allowed, the court said. Previously, the court's schedule provided that federal prosecutors were to file their initial brief by Oct. 19, with Trump's lawyers to respond by Nov. 18, and the government to file its reply by Dec. 9.
