Judge dismisses fraud case against Texas man who waited seven hours to vote

A Texas judge has dismissed voter fraud charges against Hervis Rogers, the Houston man who drew national attention – and praise – for waiting seven hours in line to vote in the March 2020 presidential primary.

Rogers, who is Black, became a symbol of tenacity when news of the circumstances surrounding his voting experience surfaced. He stuck around – despite working two jobs, including one beginning at 6am – and was among the last, potentially the last, Texas resident to vote, according to KERA news.

“I wanted to get my vote in, voice my opinion,” he said to a local ABC affiliate. “I wasn’t going to let anything stop me, so I waited it out.”

But Republican Ken Paxton, the Texas attorney general, ordered Rogers’ arrest in July 2021, for casting a ballot while on parole. Rogers became one of the dozens of voters nationwide swept up by heightened GOP efforts to pursue election fraud cases; while many Republicans insist there is widespread voting fraud, there is no evidence to support this claim, according to the Associated Press.

So Paxton prosecuted a case he had no authority to do. Typical Repugh nonsense.

And it feels like it is getting worse this election. Just read another article about voters in Georgia being challenged by other voters, but no reason is given to the "challenged" voter. This is a nightmare.

4. Was he a registered voter? Did he cast a provisional ballot? Did he cast a ballot?

I believe they charged Crystal Mason for "attempting to vote"....

The thing is, when someone arrives at the polling their name is checked in a database or registered voters. If they aren't in the database, they either can't vote or they vote provisionally. If they vote provisionally, eventually their vote won't count because they aren't registered. Crystal cast a provisional ballot, so her vote didn't even count. People who vote provisionally usually aren't turned away, but in the end, it is up to the voter to return to the elections office to prove that they are registered. (Sometimes people will cast a provisional ballot due to a glitch in the system, but that ballot will usually automatically count and their ballots will not need to be cured)

I also believe county registers are supposed to check the DPS database before registering voters. Sometimes names slip through, but whose fault is that?

Didn't he try to vote like three times in 2020? Once here in Virginia, and at least once more in NC, and I think maybe a second time in NC.

Also attempted to vote twice if I’m not mistaken. And he was not eligible at all. No gray area. Downright knowingly too young. Plain and simple.


And there was ZERO, I mean 00000000-thing done to him. N.O.T.H.I.N.G.

The longest that I ever waited in line to vote was 45 minutes in 2012. Oddly enough, 2016 and 2020 was under 20 minutes.

9. Can we make voting rights a priority?

Like.. assuming we retain control of the government, can we make that a big priority? I struggle where the exact lines should lay, but I cant see any reason any citizen should be blocked from voting. Ever. From the most saintly social worker to the lowest criminal, a vote is a vote and should be counted. Lets get past all this nonsense. make it simple and solid.
