Former President Donald Trump on Monday asked the Supreme Court to block a judges order that the IRS give years of his tax returns to the House Ways and Means Committee later this week. The request to delay the execution of the judicial order pending a planned appeal came days after Trump lost an attempt to reverse the order at a federal appeals court.
This case raises important questions about the separation of powers that will affect every future President, Trumps lawyers said in their emergency application to Chief Justice John Roberts. The chief justice has authority over such petitions from cases arising from the U.S. Court of Appeals for the District of Columbia Circuit.
Trumps lawyers asked the court to act by Wednesday to delay an appeals court ruling that cleared the way for the IRS to deliver the tax returns on Thursday. The delay would give Trump time to formally ask the high court to hear an appeal of the ruling. But the lawyers also said the Supreme Court could consider Mondays filing itself a request to hear the case.
The filing accused the committee of trying to get Trumps tax returns solely for the purpose of releasing them to the public, and not for a review of IRS audits of presidents, as the House panel has stated. Trumps attorney William Consovoy and a spokeswoman for the Ways and Means Committee did not immediately respond to requests for comment.

Former President Donald Trump asked the Supreme Court on Monday to intervene in a case in which the IRS was ordered to give years of his income tax returns to the House Ways and Means Committee. The request came after Trump lost an attempt to reverse that judicial order at a federal appeals court.
If the Supreme Court grants Trumps application, it could thwart the Democratic-controlled committee from receiving the returns for several more years at the very least. A Supreme Court case challenging the order could take months or longer to resolve. And if Republicans regain majority control in the House of Representatives in the upcoming midterm elections, they are expected to end the Ways and Means Committees three-year-long bid to get Trumps tax returns.
That committee has sought Trumps tax records and those of related business entities as part of an investigation of how the Internal Revenue Service audits presidential tax returns. The IRS, which is a division of the Treasury Department, is legally mandated to audit the annual tax returns of sitting presidents.
The committee sued to obtain Trumps federal returns for the years from 2015 through 2020 after then-Treasury Secretary Steven Mnuchin refused to comply with the committees request. The Trump appointee Mnuchin said that the panel did not have a legitimate legislative purpose.

It allows him to run out the clock on any adversary trying to get him in court. He can afford to string it out as long as possible, filing for delay after delay after delay. He knows the other side will run out of money long before he does.
Savvy strategic thinkers on our side need to find all the ways around this strategy. And immediately if not sooner!

Legislative purpose? ALL Foreign income has to be reported! Did not Eric say back in 2016 that much of the income the Trump Organization came from Russia?

The real question is who needs to be satisfied that it's #2 vs. #1? And is that subject to judicial review?

(32,082 posts)The New York IRS has had his returns since the 1960s. They are not secret to either of those organizations. If there are crimes why have they not found them? I have asked this before and I never get an answer.

Of course, what hair furhair is afraid of are possible "leaks" he would immediately label as "fake news" like forever.

Maybe DJT thought the clowns he pushed for the Court would show gratitude, but instead he's been consistently getting a full helping of the gratitude he shows to others. Dude, they're on the Court for life, you can't do a thing to them or for them now. The fool doesn't seem to realize that the Court has consistently ruled against his every fantasy.

It was reintroduced the day before the inauguration in 2021 but hasn't moved much given all that was going on at the time (so it would need to be reintroduced again in the next Congressional session in 2023).

(129,543 posts)Carolyn Maloney had taken over that Committee from Elijah Cummings after he passed, but when NY redistricted the Congressional seats, they placed her and Jerry Nadler in the same District (NY-12) and she lost to him in the primary. So she will not be returning after 30 years.
