House January 6 committee gives Trump more time to turn over subpoenaed documents

CNN The House select committee investigating the January 6, 2021, attack on the US Capitol, released a statement Friday giving former President Donald Trump more time to turn over documents it subpoenaed but offering little explanation as to why the extension was granted. We have informed the former Presidents counsel that he must begin producing records no later than next week and he remains under subpoena for deposition testimony starting on November 14th, the committee said in the statement.
The panel subpoenaed Trump last month seeking a wide array of documents by 10 a.m. Friday and for Trump to sit for an interview under oath beginning on November 14 and continuing on subsequent days as necessary. The committee also said it received correspondence from the former President and his counsel in connection with the Select Committees subpoena but did not provide additional information. CNN has reached out to Trump and his attorneys for comment.
Lawyers for Trump had accepted service of the subpoena from the committee as of October 26, according to sources familiar with the matter. Trump has criticized the committee but not said whether he would comply with the subpoena. On the day the subpoena was announced, Trumps attorney David Warrington said in a statement the committee was flouting norms and appropriate and customary process by publicly releasing the subpoena and that his legal team would respond as appropriate to this unprecedented action.
The Trump lawyers tapped to deal with the committees subpoena demands have been coordinating with other members of the former presidents legal team while determining how to proceed, according to a source familiar with the matter. Despite operating as two separate teams, the lawyers who are focused on addressing the committees subpoena are consulting with attorneys representing Trump in the Justice Departments criminal probe related to January 6, the source said, noting there are areas of potential overlap between the two separate legal matters.

(129,053 posts)They fully expected to complete their investigation and issue a final report by the end of this Congressional session as regardless of whether (D)s maintain control or not, there will be changes in the House membership post-election, just due to new members coming in to replace those who retired, passed away, or were primaried, etc.

SEC. 7. Termination and disposition of records.
(a) Termination.The Select Committee shall terminate 30 days after filing the final report under section 4.
(b) Disposition of records.Upon termination of the Select Committee(1) the records of the Select Committee shall become the records of such committee or committees designated by the Speaker; and
(2) the copies of records provided to the Select Committee by a committee of the House under section 6(a) shall be returned to the committee.

(15,646 posts)they would have already thought of that angle when they issued the original subpoena stipulation and went ahead with the original November 4th stipulation anyway. When they didnt get the information by the time stipulated, what were their options? Arrest him? But whyd they give him an additional 10 days? Wouldnt 5 or 7 have been enough? This is all very perplexing and a might frustrating.

Also note that a Congressional Committee isn't law enforcement. They are the writers of the law, so their purpose is different from DOJ and that has always been the point of their existence - to review and investigate what happened and then write up a report which can be used to draft future legislation to attempt to make sure it doesn't happen again.

(129,053 posts)HOWEVER note that whatever "sentences" (jail time, fines) they impose are based on what the prosecutor requests vs the defendant, and a judge will use the law (including "sentencing guidelines" codified in statute, past precedent, etc) to guide that decision.
So still not quite the same as the Executive Branch's role!
