Michael Flynn ordered to testify in Atlanta grand jury probe into Trump's election subversion

CNN Former national security adviser Michael Flynn must testify before an Atlanta-area special grand jury investigating efforts by former President Donald Trump and his allies to overturn the 2020 election in Georgia, a Florida judge ordered Tuesday. I am going to make a finding that the witness is indeed material and necessary in the special grand jury proceeding in the state of Georgia, said Judge Charles Roberts of the 12th Judicial Circuit Court in Florida.
Roberts also declined Flynns request that he put the order to testify on hold while the Trump ally appeals it. The special purpose grand jury in Fulton County, Georgia, is demanding that Flynn testify on November 22. Roberts noted that Flynn could ask an appeals court to put the order on hold as it is further litigated.
The order compelling Flynns testimony or the investigation came on the same day that Georgia GOP Gov. Brian Kemp appeared before the grand jury. Kemp testified for roughly three hours on Tuesday, a Kemp spokesperson told CNN, while declining to comment further. Kemp is one of a handful of witnesses left to testify in the Fulton County investigation.
At the hearing concerning the subpoena for Flynns testimony, Will Wooten with the Fulton County District Attorneys Office said there are very few witnesses left and that the likelihood is that this grand jury is not going to be hearing testimony much longer. On Wednesday, Cassidy Hutchinson, former aide to Trumps White House chief of staff Mark Meadows is scheduled to testify in Fulton County, and on Thursday, Sen. Lindsey Graham is slated to appear as a witness before the special grand jury.

The court can do wiggle room stuff with these and had done so with Ghouliani, who proffered a "medical condition" excuse for not being cleared to fly there. The judge then adjusted the date for testimony giving him extra time to get there "by train, bus, Uber..."!

(17,216 posts)Until subpoenas are actually enforced, such "orders" are one big yawn. Even should he eventually appear, nothing useful will come out of it. Suppose he lies -- he still won't be held accountable.
Until I see real consequences coming from real actions, I will remain underwhelmed by the majesty of the law.

He testified yesterday.

Gov. Brian Kemp testified for roughly three hours Tuesday before the Fulton County special grand jury examining whether former President Donald Trump and his allies criminally meddled in Georgias 2020 elections.

Kemps testimony on Tuesday was the result of a contentious court battle with the Fulton DAs office earlier this summer.The governor had initially cooperated voluntarily with the investigation. But communications soured between his team and prosecutors over the summer, according to internal emails shared in August court filings, and Kemp was eventually subpoenaed.
The day before Kemp was scheduled to appear before the grand jury on Aug. 18, the governors attorney moved to quash the subpoena, arguing that it was a politically-motivated summons designed to hurt Kemp less than 90 days before the election by Willis, a Democrat.
Fulton Judge Robert McBurney, who is overseeing the grand jury and has worked to insulate it from appearing overly partisan, rejected Kemps argument that he shouldnt have to testify. But he delayed the governors appearance until after the election. McBurney also clarified in August that Kemp is facing no accusations of criminal activity as part of the investigation.
