Senate passes bill to protect same-sex and interracial marriage over GOP opposition

WASHINGTON The Senate on Tuesday passed landmark legislation that would codify federal protection for marriages of same-sex and interracial couples, with Democrats securing enough votes to overcome opposition from most Republicans.
The Respect for Marriage Act was approved 61-36, with unanimous support from Democrats and 12 GOP votes after defeating a filibuster and rejecting three amendments offered by Republicans who oppose the bill.
The measure now returns to the House for a final vote before it can go to President Joe Biden, who said he looks forward to enacting it. With todays bipartisan Senate passage of the Respect for Marriage Act, the United States is on the brink of reaffirming a fundamental truth: love is love, and Americans should have the right to marry the person they love, Biden said in a statement.
The Senate vote reflects the rapidly growing public support for legal same-sex marriage, which hit a new high of 71% in Gallup tracking polls in June, up from just 27% in 1996 when Gallup first began polling the issue.

"We're making a really positive difference in people's lives by creating the certainty that their ability to protect their families will be lasting," Sen. Tammy Baldwin, D-Wis., the author of the bill and first openly gay lawmaker elected to the Senate, told NBC News. Senate Majority Leader Chuck Schumer, D-N.Y., said before the vote Tuesday that he was wearing the same tie he wore to the wedding of his daughter and her wife. "It's personal to me," he told reporters.

(11,100 posts)The bill would codify what I think is already the law - that a marriage lawfully contracted in one state must be acknowledged in all states. I have long been convinced that the 1996 Defense of Marriage was unconstitutional under the Full Faith and Credit Clause - Article IV, Section 1 of the United States Constitution.
For example, in Texas, first-cousins may lawfully marry (I know - Ewww). Such a marriage must be recognized in other States that forbid such marriages. Similarly, a hand full of states recognize so called common law marriage. Such a marriage must be recognized by States that require marriage licenses and some form of solemnization.

(61,900 posts)Thomas has openly named every non-Originalist precedent as a target (Roe, Griswold - contraception, Obergefell - marriage equality) except Loving (interracial marriage) as fair game for review. That doesn't mean his fellow radicals haven't targeted that as well.
Every reform in the past 100+ years may be on the table.

Should the Court overturn Obergefell, states would be at liberty to ban the performance of same-sex marriage, but a ban state must still recognize the same-sex marriage from another state.
Same-sex couples in a ban state need only travel to a free blue state to get married and then return to their state of residence (sound familiar?).
This is likely why some Republicans agreed to the bill, the appearance of states rights.
The thinking may also be that with marriage reciprocity in place, authoritarian red states would refrain from banning same-sex marriage as it would have no practical effect.
But one shouldnt underestimate the bigotry and hate of the right.

(129,096 posts)He had already voted against the motion to proceed (cloture) so I expect to mitigate being considered a liar about his supposed support for the issue, he opted not to vote at all on the final bill. He's gone after this congressional session is done.

LDS has been consistently not just against any recognition of same sex marriage but against non hetero orientation itself. Theyve certainly come a long way. Maybe even decades ahead of RCC (although that one is more of a criminal enterprise).
