Appeals court says people convicted of nonviolent crimes can own guns

The U.S. government cannot ban people convicted of non-violent crimes from possessing guns, a federal appeals court ruled on Tuesday.

The ruling is the latest defeat for gun control advocates in the wake of a Supreme Court decision last year that expanded gun rights nationwide.

The decision stems from a 2020 lawsuit by a Pennsylvania man, Bryan Range, who was barred under federal law from possessing a gun after pleading guilty to welfare fraud. He claimed the prohibition violated his right to bear arms under the Second Amendment of the U.S. Constitution.

Circuit Judge Thomas Hardiman wrote for the majority on Tuesday that the government had failed to point to any laws from the United States’ founding establishing a tradition of disarming non-violent criminals

Well, let's see. Gun ownership is a constitutional right. (2nd amendment.)

Voting is a constitutional right. (15th, 19th and 26th.)

So, if non-violent felons can still own guns, then can non-violent felons still vote? Shouldn't this ruling effectively restore voting rights for all ex-felons of non-violent crimes instantly?

Violence and voting do not. I think all felons should be able to vote.

But I agree with the decision by this judge. Violent offenders are more likely to use a gun to commit violent acts, so prohibiting them from gun ownership makes sense. If people in general are allowed to own guns, then nonviolent offenders should be able to own them as well since they are not more likely to commit violent acts.

I dislike guns and wish that semi-auto weapons would be banned, but this particular legal effort really does curb gun rights without legitimate justification, rights that exist whether we like them or not.

I'd go further and say ALL ex-felons, regardless of their crime, should get their voting rights back once their sentences are served.

As for guns, I don't want violent ex-felons to possess them.
