Former President Donald Trump has been indicted for a second time, this time on federal charges in relation to his handling of classified information while out of office, sources familiar confirm to ABC News. The former president faces at least seven charges, sources tell ABC News, which include willful retention of national defense information, conspiracy to obstruct justice, withholding a document or record, corruptly concealing a document or record, concealing a document in a federal investigation, scheme to conceal, and false statements and representations.
Maximum sentences for the respective charges, per their statutes, range from five up to 20 years, although any eventual sentence should Trump be convicted would likely be much lower. Trump is set to be arraigned in federal court in Miami on Tuesday at 3 p.m. ET, sources said.
In a statement on social media, Trump wrote Thursday he had been told of the indictment and insisted the case was a "hoax." He has repeatedly denied wrongdoing. Trump wrote he is "INNOCENT" and it was a "DARK DAY" for the U.S. Trump also claimed he is innocent in a video posted to Truth Social, saying: "I am innocent. We will prove that very, very soundly and hopefully very quickly. Thank you very much."
Spokespeople for the Justice Department and special counsel Jack Smith's office declined to comment on Trump's statement. He said he was "summoned." That does not mean he's been indicted, and until an official - not anonymous sources - confirm it, I remain skeptical.

Donald Trump's attorney Jim Trusty confirmed Thursday night that the former president has been charged with seven counts and revealed that the charges break out from an Espionage Act charge.
"It does have some language in it that suggests what the seven charges would be. Not 100% clear that all of those are separate charges, but they basically break out from an Espionage Act charge," he told CNNs Kaitlan Collins.
Trusty called the espionage charge ludicrous, and added that there are also several obstruction-based-type charges and then false statement charges.
He said his team did not get a copy of the indictment but instead received a summons via email. Trusty refused to reveal when his team received the initial letter from the Justice Department that listed Trump as a target of their investigation.
He confirmed that Trump will appear in court Tuesday but would not say which attorneys will be present with the former president.

My husband wanted to check how Pox Noise is covering it. I sat through about 60 seconds of it, which was more than enough. And they were DESPERATE to rope President Biden into it, about some obscure I-dont-know-what that hes supposed to maybe/kinda/sorta/coulda done when he was Vice President (from what Ive read, its a single flimsy complaint that holds no water and enjoys no basis in fact). (7,788 posts)of justice case. I don't know the specifics of the indictment yet, but using 'classified documents' as a catch all is underselling what has happened and may be an example of soft-peddling to walk a fine line.
Not all his transgressions were about just accidentally having classified docs. There are non-classified docs he's not allowed to keep. There are certainly obstruction charges. But at its core, this is about national security, something he doesn't give a whiff about, obviously.
Better memes: Espionage Act. National Security. Willful obstruction. Lying. national secrets. Endangering lives. These start to convey the seriousness and should be included when referring to this case. will be more accurate and will keep die hards from comparing his 'classified docs' issue with others who were found to have them as well.
