Donald Trump indicted for 2nd time, in classified documents investigation: Sources

Last edited Fri Jun 9, 2023, 06:04 AM - Edit history (4)

Source: ABC News

Former President Donald Trump has been indicted for a second time, this time on federal charges in relation to his handling of classified information while out of office, sources familiar confirm to ABC News. The former president faces at least seven charges, sources tell ABC News, which include willful retention of national defense information, conspiracy to obstruct justice, withholding a document or record, corruptly concealing a document or record, concealing a document in a federal investigation, scheme to conceal, and false statements and representations.

Maximum sentences for the respective charges, per their statutes, range from five up to 20 years, although any eventual sentence should Trump be convicted would likely be much lower. Trump is set to be arraigned in federal court in Miami on Tuesday at 3 p.m. ET, sources said.

In a statement on social media, Trump wrote Thursday he had been told of the indictment and insisted the case was a "hoax." He has repeatedly denied wrongdoing. Trump wrote he is "INNOCENT" and it was a "DARK DAY" for the U.S. Trump also claimed he is innocent in a video posted to Truth Social, saying: "I am innocent. We will prove that very, very soundly and hopefully very quickly. Thank you very much."

Spokespeople for the Justice Department and special counsel Jack Smith's office declined to comment on Trump's statement. The unprecedented federal indictment of a former president -- who already faces a criminal case in New York City that he denies and who is the current front-runner for the Republican Party's nomination for the White House in 2024 -- further underlines what are potentially the most consequential prosecutions in U.S. history, with both global and domestic implications.

"We're learning from our sources that there appear to be at least seven counts here. This ranges from everything from the willful retention of national defense information to conspiracy to a scheme to conceal, to false statements and representations," ABC News' Katherine Faulders reported during a special report on the network.

Experts say a current U.S. government criminally prosecuting its former leader and current leading opposition party candidate upends long-held norms and could test the nation's democratic system in a manner that stretches far beyond the merits of the case itself.

BREAKING: Donald Trump announces that the Justice Department just “informed” his attorney’s that he has “been indicted” and “summoned to appear at the Federal Court House in Miami on Tuesday at 3 PM.”

Here is Trump’s unhinged announcement:

“The corrupt Biden administration has informed my attorneys that I have been indicted, seemingly over the Boxes Hoax, even though Biden has 1,850 boxes at the University of Delaware, additional boxes in Chinatown, D.C., with even more boxes at the University of Pennsylvania, and documents, strewn all over his garage floor where he parks his Corvette, which is “secured” only by a garage door that is paper thin, an open most of the time. I have been summoned to appear at the federal courthouse in Miami on Tuesday at 3 PM. I never thought it possible that such a thing can happen to a former President of the United States.”

Please retweet and ❤️ if you’re THRILLED that Trump just got federally indicted — and consider joining the growing exodus to Tribel, a new Twitter competitor that is exploding in popularity because Elon Musk banned Tribel’s Twitter account — but he forgot to ban this link to download the new Tribel app: http://tribel.app.link/okwPIHYCIqb

Trump's attorney confirms former president faces 7-count indictment

From CNN's Kaanita Iyer

Donald Trump's attorney Jim Trusty confirmed Thursday night that the former president has been charged with seven counts – and revealed that the charges “break out from an Espionage Act charge.”

"It does have some language in it that suggests what the seven charges would be. Not 100% clear that all of those are separate charges, but they basically break out from an Espionage Act charge," he told CNN’s Kaitlan Collins.

Trusty called the espionage charge “ludicrous,” and added that there are also “several obstruction-based-type charges and then false statement charges.”

He said his team did not get a copy of the indictment but instead received a summons via email. Trusty refused to reveal when his team received the initial letter from the Justice Department that listed Trump as a target of their investigation.

He confirmed that Trump will appear in court Tuesday but would not say which attorneys will be present with the former president.

The Justice Department took the legally and politically momentous step of lodging federal criminal charges against former President Donald J. Trump, multiple people familiar with the matter said on Thursday, following a lengthy investigation of his handling of classified documents that he took with him upon leaving office and then obstructing the government’s efforts to reclaim them.

My husband wanted to check how Pox Noise is covering it. I sat through about 60 seconds of it, which was more than enough. And they were DESPERATE to rope President Biden into it, about some obscure I-don’t-know-what that he’s supposed to maybe/kinda/sorta/coulda done when he was Vice President (from what I’ve read, it’s a single flimsy “complaint” that holds no water and enjoys no basis in fact). I moved to another room to watch the adults who were in charge of the breaking news coverage.

The indictment, filed in Federal District Court in Miami, is the first time in American history a former president has faced federal charges. It puts the nation in an extraordinary position, given Mr. Trump’s status not only as a onetime chief executive but also as the front-runner for the 2024 Republican presidential nomination to face President Biden, whose administration will now be seeking to convict his potential rival.

Mr. Trump was charged with a total of seven counts, including willfully retaining national defense secrets in violation of the Espionage Act, making false statements and an obstruction of justice conspiracy, according to people familiar with the matter.

They have been discussing on MSNBC. Basically DOJ is trying to make sure that it is tried in the correct venue - where MOST of the activities occurred, which would have been in FL - FOR the "documents" case.

The J6 case will involve whatever went on in D.C.

of justice case. I don't know the specifics of the indictment yet, but using 'classified documents' as a catch all is underselling what has happened and may be an example of soft-peddling to walk a fine line.

Not all his transgressions were about just accidentally having classified docs. There are non-classified docs he's not allowed to keep. There are certainly obstruction charges. But at its core, this is about national security, something he doesn't give a whiff about, obviously.

Better memes: Espionage Act. National Security. Willful obstruction. Lying. national secrets. Endangering lives. These start to convey the seriousness and should be included when referring to this case. will be more accurate and will keep die hards from comparing his 'classified docs' issue with others who were found to have them as well.

Donald Trump charged with illegal retention of classified documents
Twice-impeached ex-president is being prosecuted for violating Espionage Act and obstruction over documents held at Mar-a-Lago

Federal prosecutors have charged Donald Trump with violating the Espionage Act and conspiring to obstruct the criminal investigation among other counts, according to a person familiar with the matter, a historic development marking the most significant legal peril yet for the former president.

The exact nature of the seven-count indictment is unclear because it remains under seal.

At least some of the counts filed in federal district court in Miami by the office of special counsel Jack Smith include the willful retention of national defense information, obstruction of justice, conspiracy, false statements and concealment under title 18 of the US criminal code, the person said.
