Court agrees to block collection of Trump's massive civil fraud judgment if he puts up $175M

Source: AP

Updated 1:09 PM EDT, March 25, 2024

NEW YORK (AP) — A New York appeals court on Monday agreed to hold off collection of former President Donald Trump’s more than $454 million civil fraud judgment — if he puts up $175 million within 10 days.

If he does, it will stop the clock on collection and prevent the state from seizing the presumptive Republican presidential nominee’s assets while he appeals. The appeals court also reversed other aspects of a trial judge’s ruling that had barred Trump and sons Eric Trump and Donald Trump Jr., the family company’s executive vice presidents, from serving in corporate leadership for several years.

In all, the order was a significant victory for the ex-president as he defends the real estate empire that vaulted him into public life. The development came just before New York Attorney General Letitia James, a Democrat, was expected to initiate efforts to collect the judgment.

Trump, who was attending a separate hearing in his criminal hush money case in New York, hailed the ruling and said he would post a bond, securities or cash to cover the $175 million sum in the civil case. Speaking in a courthouse hallway, Trump revisited his oft-stated complaints about civil trial Judge Arthur Engoron and the penalty he imposed.

NEW YORK (AP) -- A New York appeals court on Monday agreed to hold off collection of former President Donald Trump's $454 million civil fraud judgment -- if he puts up $175 million within 10 days. If he does, it will stop the clock on collection and prevent the state from seizing the presumptive Republican presidential nominee's assets while he appeals.

The development came just before New York Attorney General Letitia James was expected to initiate efforts to collect the judgment. Messages seeking comment were sent to James' office and to Trump's lawyers. Trump's lawyers had pleaded for a state appeals court to halt collection, claiming it was "a practical impossibility" to get an underwriter to sign off on a bond for such a large sum.

The ruling was issued by the state's intermediate appeals court, the Appellate Division of the state's trial court, where Trump is fighting to overturn a judge's Feb. 16 finding that he lied about his wealth as he grew the real estate empire that launched him to stardom and the presidency.

After James won the judgment, she didn't seek to enforce it during a legal time-out for Trump to ask the appeals court for a reprieve from paying up.

Mon Mar 25, 2024, 08:41 PM
Mar 25

For example, in Florida, no matter how large the judgment, the defendant cannot be required to put up a bond of more than $50 million, and the court still retains the authority to set the bond at an even lower level.

New York is one of the few states without a cap on the bond requirement, but it allows judges to set it below 100 percent of the judgment. I don't have any data, but under the circumstances, it wouldn't be a surprise if New York judges set the bond at below the 100 percent level in a lot of cases where the judgment is large -- more than $100 million.

This little wrinkle is disappointing, and it gives Chump another delay that's completely undeserved. However it will not in any way cause him to win the November election. Chump will once again be a loser in November, and no judge on any bench will change that.

Meanwhile the State of New York will proceed with this fraud conviction and fight the appeal with everything they can muster. If it takes a few more months, well OK. After all, Chump has been frauding and criming in New York for well over 30 years. The important thing to remember is that he cannot and will not win the White House in November.

NYS is still on the right track and AG Letitia James is singing Tom Petty's hit song "I Won't Back Down."

All five judges were appointed by Democratic governors. In fact, of the 21 judges assigned to that department, 20 are appointees of Democratic governors and all seven of the judges on the NY Court of Appeals (the highest level in the NY courts) are appointees of Democratic governors.

Over 8 years of anticipating justice is enough.
Trump will never, ever suffer real consequences for his crimes, I'm convinced and want to stop hoping.
Someone ALWAYS steps up to protect Trump from serious consequences.

He has dodged justice over and over again for his whole life and now he has millions of people in and outside of the legal system that are willing to sacrifice their careers and even go to prison, just so he doesn't have to face justice for his crimes.

We should stop expecting justice.
It is not going to happen.

If I'm mistaken, then this bond ruling and stay comes from a panel on the New York Appellate Division of the NY Supreme Court. Media under-inform the public, as usual, and/or don't want to be bothered to name the judges who ruled to lower Trump's bond.

The court did not grant requests from Trump to prohibit the independent monitor or installing an independent director of compliance.

The AG's office brushed off Monday's ruling in a statement, saying: "Donald Trump is still facing accountability for his staggering fraud. The court has already found that he engaged in years of fraud to falsely inflate his net worth and unjustly enrich himself, his family, and his organization. The $464 million judgment — plus interest — against Donald Trump and the other defendants still stands."

appointed by Democratic governors.

New York's court system can be confusing. The trial court is called the Supreme Court; the intermediate appeals court is called the Appellate Division; and the highest level appeals court is called the Court of Appeals.

There are 21 judges assigned to the appellate division that covers New York City -- 20 of them were appointed by Democratic governors and the five that issued the order reducing the appeals bond were all appointed by Democratic Governors.

The seven justices of the Court of Appeals, as you point out, also are appointees of Democratic governors.

Anil Singh, a judge born in India who immigrated to the US, went to Antioch Law School, and prior to becoming a judge worked for another judge who started out representing criminal defendants for the Legal Aid Society.

Lizbeth Gonzalez, a Latina judge who previously served as Visiting attorney for the Puerto Rican Legal Defense & Education Fund and as a
Senior attorney for MFY Legal Services (aka Mobilization for Justice, an organization providing legal services to low-income New Yorkers).

Bahaati Pitt-Burke, a Black jurist who previously worked for the Legal Aid Society.

Kelly O'Neill Levy, previously served as a principal law clerk to the late Judge Rose Rubin, one of the first women to become a New York judge and also served on the Board of Directors of the Women’s Bar Association and the Board of Trustees of the Community Service Society of New York.

Probably can come up with it, but, it's not a given. From previous reporting, all the people he went to for $450 million refused to take any real estate as collateral because his "real estate empire" either does not belong to him, he just pays for the right to put his name on it, or, it's mortgaged to the hilt and is worth nowhere near what he claims.
