Trump election interference case picks back up after Fani Willis disqualification bid

The judge overseeing former President Donald Trump's Georgia election interference case has scheduled a Thursday hearing to hear oral arguments on a number of motions from Trump and his co-defendant David Shafer. The hearing will be the first since the failed disqualification effort against Fulton County District Attorney Fani Willis, who brought the case.
It comes after Judge Scott McAfee granted Trump permission to appeal his disqualification ruling -- but vowed to move the case forward in the meantime.
McAfee earlier this month declined to outright disqualify Willis based on accusations that she benefited financially from a romantic relationship with prosecutor Nathan Wade, but ruled that either she or Wade must step aside from the case. Wade subsequently resigned as special prosecutor.
Trump and 18 others pleaded not guilty last August to all charges in a sweeping racketeering indictment for alleged efforts to overturn the results of the 2020 presidential election in the state of Georgia.

Trump's motion asked the court to dismiss the case based on his First Amendment right to free speech.
McAfee has dismissed two similar motions by co-defendants Kenneth Chesebro and Sidney Powell. Both co-defendants later pleaded guilty.
According to the Atlanta Journal-Constitution, Trump would have to admit that his claims about the 2020 election being rigged were false to pursue a First Amendment defense.
Judge Chutkan has also rejected this line of defense

(8,699 posts)This is not "the trial". We are no where near an actual trial yet.
We are still in the pre-trial motions phase. This could drag on for months.
Once past that it is the jury selection phase. That could take up to a year.
I will not be surprised if this case is still ongoing even another 4 years from now.

(129,067 posts)there were 4 PLEA BARGAINS, 2 of them from Kraken lawyers Sidney Powell and Jenna Ellis, one from the "fake electors" architects - Ken Chesbro, and the 4th an actual GA fake elector.
So some of the "top tier" have already fallen without even needing a trial.
