The lawsuits to block President Joe Biden's student-debt relief efforts are back. On Thursday, 11 state attorneys general — led by Kansas' Kris Kobach — filed a lawsuit to block Biden's SAVE income-driven repayment plan, implemented over the summer to give borrowers cheaper monthly payments with a shorter timeline for relief.

The lawsuit, filed in Kansas' district court against Biden and Education Secretary Miguel Cardona, stated that the "lawsuit is now necessary to prevent Defendants from continuing to flout the law, which includes ignoring Supreme Court decisions," referring to the high court's decision at the end of June to strike down Biden's first attempt at broad student-loan forgiveness using the HEROES Act of 2003.

"Once again, the Biden administration has decided to steal from the poor and give to the rich," Kobach said during a Thursday press conference. "He is forcing people who did not go to college, or who worked their way through college, to pay for the loans of those who ran up exorbitant student debt. This coalition of Republican attorneys general will stand in the gap and stop Biden."

Last month, the Education Department implemented a provision of the SAVE plan ahead of schedule: $1.2 billion in debt relief for 153,000 borrowers who originally borrowed $12,000 or less and made as few as 10 years of qualifying payments. The lawsuit argued that the relief was "in defiance of the Supreme Court" and asked the federal court to declare the SAVE plan unconstitutional and require borrowers to make payments.

The simple solution is that the students of those eleven states are excluded from the loan forgiveness program.

4. I have no problem with loan forgiveness for those that have atleast repaid the original amount of the loan.

After all the one and only goal with helping people with loans for their education should to help them make their lives better than they would have been.
Now one thing as part of such loans I would not mind being added in the future should be a requirement that they also donate a little of their talent and help by giving back to the community itself as well.
Not alot of time but a little even if its something as simple as helping for a day at a homeless shelter once a month.

forcing low income people to borrow money for an education-this country needs educated people apparently only the monied should be educated so the low classes can be manipulated-maybe some of you have too much money and are the source of the problems in this county

I thought to have a lawsuit you needed standing to file. What damage is being done to the states by Biden's action?

Standing didn’t stop the SCOTUS from killing student loan debt relief the first go around. And that one was actually written in the COVID relief bill that the President could modify or alter loan terms as needed for the pandemic. Roberts et al, stood on their heads and did all kinds of legal gymnastics to get the outcome they wanted.

Fucking assholes.

should have zero impact on banks (other than the loss of servicing revenues) and should also not impact any state as these loans being forgiven are federally guaranteed student loans.

I am not sure how or why states have standing to file suit as they are not being injured by this forgiveness.

The states that sued then didn’t have standing, and Roberts, Uncle Slappy Thomas, Scammy Alito, etc., totally ignored that fact.

People are focusing on forgiveness. But the new repayment options make payments affordable for virtually all borrowers.
