Federal judge temporarily halts alleged indiscriminate immigration stops

Source: LA Times

A federal judge on Friday temporarily blocked the Trump administration from carrying out what advocates allege are unlawful stops and arrests that have terrorized Angelenos, forced some immigrants into hiding and damaged the local economy.

The ruling from U.S. District Judge Maame Ewusi-Mensah Frimpong, a Biden appointee, came after a hearing Thursday in a lawsuit filed on behalf of several immigrant rights groups, three immigrants picked up at a bus stop and two U.S. citizens, one whom was held despite showing agents his identification.

In her ruling, Frimpong said she found a sufficient amount of evidence that agents were stopping people based on their race, language, their vocation or the location they are at, such as Home Depot or a carwash, to form reasonable suspicion to stop someone for possible immigration law violations.

Frimpong said in her order that reliance on those factors — either alone or in combination — does not meet the requirements of the 4th Amendment.

But it took way too long.

Anyone who knows even a modicum of the Constitution knows it is unconstitutional.

And let’s just say you know zip about the Constitution. Do you read the news? Do you listen to radio or tv? News updates on your phone? There has been plenty of information on stop and frisk started by Rudy Guiliani, which is pretty much the same thing.

Back in the mid 90s, the NJ state troopers were racially profiling and the state had to shell out considerable amounts for doing so. ACLU case.

Sadly, NYC’s mayor, a black man, has resumed stop and frisk:

He denies resuming it. How trumpian of him.

I can’t imagine being afraid of going some place because of how I looked. It would affect everything about one’s day to day existence.

That it took a long time because the lawyers did very thorough, competent work.

This must be very current since I just learned of it while cooking in my kitchen and I was listening to MSNBC, waiting for Lawrence since I can't take too much "news" at any given time without wanting to jump off a bridge.

Now I can go to sleep feeling a little bit better than I did 24 hours ago.

Don't forget the next huge mass protest scheduled in over 1,000 US cities on Thursday, July 17th between 5 PM and 8 PM.

Citizens, like what we saw in LA .

On edit: if ICE continues, the person they go after could claim assault. How the police respond should be decided immediately, so there is some game plan.

If the police do nothing, the people on the streets will continue to resist ICE attempts to detain.

Tom Homan’s comments about ICE agents being able to detain people based on “their physical appearance” will likely make racial profiling concerns worse.

Nearly six months into his tenure as the White House’s “border czar,” Tom Homan has made a great many controversial public comments, about everything from due process to prosecuting news organizations to his curious focus on Democratic Rep. Alexandria Ocasio-Cortez of New York.

But we’re often reminded that his rhetorical record is still growing.

In his latest Fox News appearance, Homan said: “Look, people need to understand, ICE officers and Border Patrol don’t need probable cause to walk up to somebody, briefly detain them, and question them. They just need totality of the circumstances, right? They just go through the observation, get our typical facts — based on the location, the occupation, their physical appearance, their actions.”

NBC News reported earlier this year about concerns related to racial profiling as part of the Trump’s administration immigration raids, and hearing the White House border czar talk about ICE agents being able to detain people based on “their physical appearance” will likely make those concerns worse.

What's more, Homan's on-air comments sparked quick pushback from Capitol Hill. Rep. Daniel Goldman said via Bluesky that the border czar's assessment was "patently false."

The New York Democrat added, "DHS has authority to question and search people coming into the country at points of entry. But ICE may not detain and question anyone without reasonable suspicion — and certainly not based on their physical appearance alone. This lawlessness must stop."
