A second nonprofit group attempting to clear the way for the public disclosure of special counsel Jack Smith's full report on the Mar-a-Lago investigation of President Donald Trump's alleged mishandling of classified documents following his first term in office urged U.S. District Judge Aileen Cannon to rule on its request to intervene and undo an injunction she put in place 171 days ago — an order the DOJ is currently using to its advantage to resist a New York Times lawsuit.

In Cannon's Jan. 21 injunction blocking the release of Smith's Mar-a-Lago report, she pointed out that Trump valet Waltine Nauta and Mar-a-Lago property manager Carlos de Oliveira still had an active appeal in the 11th U.S. Circuit Court of Appeals and that, as a result, they "retain — as all parties agree — due process rights to a fair trial that would be imperiled by public dissemination of Volume II."

"In short, the Department offers no valid justification for the purportedly urgent desire to release to members of Congress case information in an ongoing criminal proceeding," wrote Cannon, the judge who dismissed the president's Espionage Act case and invalidated Smith's appointment as special counsel last July. "Meanwhile, on the other side of the balance, there are two individuals in this action, each with constitutional rights to a fair trial, who remain subject to a live criminal appeal of this Court's Order Dismissing the Superseding Indictment."

At the time of the injunction, the judge noted, the freshly installed Trump administration DOJ had yet to toss the cases against Trump's now former co-defendants.

Republicans know their ideas and policies are antithetical to what the majority of Americans
want and need so they have to cheat and been doing so for years. Remember good Chuck
Grassley who on January 5th, 2021 said something to the effect of, “I don’t see Vice President
Pence being here tomorrow to certify the vote.” And on J-6th when the mob attacked the U.S.
Capitol which has something like 650 windows of which only 12 were not bomb proof and 2
doors that weren’t blast proof and the thugs hit each and every one of them. Inside Republican
knowledge @ work. Cannon was installed to protect Trump from being held accountable for
his multiple crimes because he is a useful idiot to the rich and powerful.

and she had been a Democratic appointee, then the current House GOP would have ceased all work and started Impeachment hearings and would have voted to impeach... and then the Senate would have accepted the impeachment for a trial (with no guarantee that they would have enough votes to table it or send it to committee to dispense with the matter like they were able to do when they impeached Mayorkas).

and they now have appropriations bills for FY'26 to do, and even planning for a follow-on "BBB" starting next FY that has been rumored (they can do reconciliation once for each type, either as a single bill or combos, each FY).

But we have almost ~1.5 years left with them unless/until we take back at least the House in 2026.

then we'll have them. The fact that you have TX spending (wasting) time right now in a "Special Legislative Session" discussing "redistricting" (and OH considering the same) means they seem to have concerns about and intent on trying to "bolster their slim majorities". If they weren't planning on elections, they wouldn't bother interrupting their summer vacations redrawing lines that would have no relevance.

but I've been trying to monitor what the red states are doing when it comes to the upcoming federal elections. A post-2026 U.S. might be very different where the threat becomes real.
