CBS Denies Forcing Stephen Colbert to Not Air Interview With Democratic Candidate, Says It Provided 'Legal Guidance'

Source: Variety

Feb 17, 2026 11:51am PT

CBS said it did not force “The Late Show With Stephen Colbert” to pull an interview with Texas state Rep. James Talarico from its TV broadcast Monday, contrary to the way the late-night host had framed it. Rather, according to CBS, its legal team provided “guidance” to “The Late Show” that Talarico’s appearance could “trigger the FCC’s equal-time rule.”

In a statement Tuesday, CBS said, “‘The Late Show’ was not prohibited by CBS from broadcasting the interview with Rep. James Talarico. The show was provided legal guidance that the broadcast could trigger the FCC equal-time rule for two other candidates, including Rep. Jasmine Crockett, and presented options for how the equal time for other candidates could be fulfilled. ‘The Late Show’ decided to present the interview through its YouTube channel with on-air promotion on the broadcast rather than potentially providing the equal-time options.”

On Monday’s episode of “The Late Show,” Colbert said CBS lawyers had blocked him from airing an interview with Texas state Rep. James Talarico, who is running for U.S. Senate, over the FCC’s recent warning that it would consider enforcing the agency’s “equal time” political rules for late-night and daytime talks shows. Colbert also claimed the network’s legal team told the host specifically to not to discuss the matter on air.

Talerico “was supposed to be here, but we were told in no uncertain terms by our network’s lawyers, who called us directly, that we could not have him on the broadcast,” Colbert said on the show. “Then I was told — in some uncertain terms — that not only could I not have him on, I could not mention me not having him on. And because my network clearly doesn’t want us to talk about this, let’s talk about this.”

on consecutive shows so they each would have the "full time" during that show's segment, to make remarks and respond to his questions, instead of having what would amount to a crowd of competing voices on at the same time in a limited time slot.

I don’t believe a word CBS (aka Bari Weiss) says. They’re denying because they didn’t expect a) for Colbert to call them out, even though they explicitly told him not to talk about it, b) for Colbert to actually proceed with the interview and post it on YouTube, c) for millions to have already viewed it less than 24 hrs later, and d) for the intensity of the blowback.

However I believe it was actually recorded earlier ... like maybe a week or so earlier? I don't know this for sure, but Colbert had last week off, and the James Talarico interview segment was done before a live audience.

So maybe what happened is this: the live show was taped around 5 p.m. and then it was edited before CBS put on the air over a week ago. The Talarico segment was taken out and Colbert raised a stink about it with management afterwards. He was told he can't broadcast it on CBS, but he can use it on his own podcast. That's basically what he did, however he revealed all of this last night during the Late Show.

The show is taped around 5 p.m. so it didn't all happen on the SAME DAY. How could the segment have been edited, and the meeting taking place, and Colbert talking about it on the air at 11:30 last night? Not unless this is "Back to the Future" Part Z.

how networks execs were selling out the First Amendment to curry favor with corrupt politicians to which Colbert responded
"To fact-check you, my network said our cancellation was a purely financial decision and I remain grateful for the last eleven years."

It seems that he was covering legal bases, but it also seemed like a dig. Sometimes you can't tell with Colbert. Part of his genius?
