A state appeals panel has sided with the state Department of Corrections in rejecting a transgender woman’s bid to transfer to a women’s prison from an all-gender facility where she was civilly committed for sex offender treatment.

The resident, identified only as S.G. in the Wednesday ruling, said her placement in a special treatment unit on the grounds of East Jersey State Prison in Avenel violates the state Law Against Discrimination. She applied in 2023 for a transfer to the Edna Mahan Correctional Facility for Women, the department denied her request in January 2024, and she appealed to the courts.

Judge Mark K. Chase, writing for a three-judge panel, agreed corrections officials treat S.G. differently — but not because of her gender identity or expression. The Department of Corrections is required by law to house sexually violent predators separately from people serving criminal sentences, and the special treatment unit is the system’s only treatment facility for them, he noted.

“This classification is not arbitrary, capricious, or unreasonable. It serves the statutory purpose — protection of society and provision of treatment,” Chase wrote. “The LAD prohibits exclusion and indignity yet does not compel sex-segregated facilities for civilly committed persons.”

She served her time at the Adult Diagnostic and Treatment Center, the state�s prison for male sex offenders that�s also in Avenel, and was civilly committed by the court in 2019 under the state Sexually Violent Predator Act, the ruling says.

5. No one should be mistreated in prison

The current treatment of transgender people in US prisons is barbaric. They are being forced into conversion therapy and being ‘treated’ with quack science, when they are not being systematically raped daily while the prison guards laugh.

We should not torture people. As a society, we should be above this. It doesn’t matter what they did, even if it’s the most evil acts on earth.

I get the impulse to say “Child molesters deserve only the worst punishment.” However, by allowing this, we are as a society agreeing that some torture is ok. If torturing transgender child molesters is ok, then, maybe we can torture transgender thieves? If torturing transgender thieves is ok, maybe torturing thieves is ok? If torturing thieves is ok, maybe torture is ok for general use?

We are better than this, or, should be.

I think this person is a monster, obviously. We should also still work towards treating EVERYBODY humanely in prison.

Please point out where I said “you only want to see her suffer because she’s transgender?” Reread my post, please, and stop flipping out over something I never said. We can treat people humanely and still keep them in prison where they belong (like this person). If you read my post as saying anything else, or saying that the person is in jail because they are transgender or is hated just because they are transgender, you have severely misread my post or assumed something.

Also, I urge you to look up v-coding, as an example. Most transgender people are severely mistreated in prison, and, it is because they are transgender. I thought this point was pretty obvious in my post.
