WASHINGTON (AP) — Steve Bannon, a longtime ally of President Donald Trump, on Monday won a Supreme Court order that is expected to lead to the dismissal of his criminal conviction for refusing to testify to Congress.

Prodded by the Trump administration, the justices threw out an appellate ruling upholding Bannon’s conviction for defying a subpoena from the House committee that investigated the Jan. 6, 2021, attack by a mob of Trump supporters on the U.S. Capitol. The move frees a trial judge to act on the Republican administration’s pending request to dismiss Bannon’s conviction and indictment “in the interests of justice.”

The dismissal would be largely symbolic. Bannon served a four-month prison term after a jury convicted him of contempt of Congress in 2022. A federal appeals court in Washington had upheld the conviction.

The justices also issued a similar order in the case of former Cincinnati Councilman P.G. Sittenfeld, who was pardoned by Trump last year. Sittenfeld had served 16 months in federal prison after a jury convicted him of bribery and attempted extortion in 2022. The high court order allows a lower court to consider dismissing his indictment.

The Supreme Court on Monday granted the Trump Justice Department’s request to vacate an appeals court ruling against Steve Bannon, after the Department of Justice told the high court that it wants to dismiss the matter that was brought against the Donald Trump ally during the Biden administration.

The high court relief doesn’t officially dismiss the case, but it clears a path for that conclusion, as the DOJ has a pending motion in the trial court seeking dismissal. The next step will play out in the lower courts.

Bannon was convicted in 2022 for not complying with the House Jan. 6 select committee. He served a four-month sentence after the justices refused in the summer of 2024 to let him stay free while he appealed. He continued his appeal after serving his time, filing a petition with the justices in October after his appeals court loss. ....

As is typical in such cases, the Supreme Court didn’t issue an opinion to explain why it took the action it did on Monday’s order list, which is a routine document containing the court’s latest announcements on pending appeals. All the court said was: “The petition for a writ of certiorari is granted. The judgment is vacated, and the case is remanded to the United States Court of Appeals for the District of Columbia Circuit for further consideration in light of the pending motion to dismiss the indictment.”

The DOJ didn’t specify why it wants to abandon the case at this point, only that it “has determined in its prosecutorial discretion that dismissal of this criminal case is in the interests of justice.” In its brief to the justices, the DOJ cited cases stemming from the FIFA corruption scandal in which the government recently sought and received similar high court relief on criminal defendants’ behalf.

“The government’s decision to dismiss an ill-conceived prosecution even at this late stage is commendable,” Bannon’s lawyers wrote in his final brief to the justices in February.

The lackeys in the DoJ now won't lift a finger to continue, so the SC just says "end of case"?

I expect the next stage will be him suing "the DoJ" for bringing the case, and the current hive of scum and villainy saying "yes, how many million would you like of taxpayers' money?"

... on the Dark Side of the SCOTUS choose, yet again, to pervert the course of justice in deference to lawless conservative elements utterly devoid of any redeeming qualities whatsoever. As if we needed any more proof that partisan politics should be erased forever from the selection, nomination, or confirmation of judges or justices. All such candidates should foreswear any political affiliation, and attendance of events sponsored by partisan entities should be strictly forbidden.

Bannon challenged his contempt conviction. The Trump administration agreed his conviction should be vacated. The only amicus brief, from the state of Iowa, agreed. No one presented the Court with any counter-arguments.

So the Court had essentially no choice but to vacate and remand.

Folks can blame Roberts, but its all but certain that the entire court agreed with this result given the circumstances.

given that the GOP took control over the prosecutions once Democrats lost the Presidency, the outcome was sealed (like the dismissals of all the charge against the 1600+ J6 criminals when they were pardoned and charges against Eric Adams).

In an unrelated case, Bannon did do a plea deal with NY state on his "Build the Wall" fraud last February so is still a felon - https://www.democraticunderground.com/10143393873
