Sponsors Of Calif. Gay Marriage Ban Ask Supreme Court To Halt Weddings They Say Were Premature

SAN FRANCISCO Less than 24 hours after California started issuing marriage licenses to same-sex couples, lawyers for the sponsors of the state's same-sex marriage ban filed an emergency motion Saturday asking the U.S. Supreme Court to step in and stop the weddings.

Attorneys with the Arizona-based Alliance Defending Freedom claim in the petition that the 9th U.S. Circuit Court of Appeals acted prematurely and unfairly on Friday when it allowed same-sex marriage to resume by lifting a hold it had placed on same-sex unions while a lawsuit challenging the ban made its way to and through the Supreme Court.

Alliance Defending Freedom Senior Counsel Austin Nimocks says the Supreme Court's consideration of the case is not done yet because his clients still have 22 days to ask the justices to reconsider their decision holding that Proposition 8's backers did not have legal authority to defend the ban.

Actually, my life sucks. It is 100 freakin' degrees in San Jose, where 85 is considered a heat wave. Meanwhile, my boss abandoned us to take a fat, cushy state job in Sac. So now my job mostly consists of looking at pictures of people's cats on teh Interwebs. Anyone looking for a public policy advocate out here? Or anywhere? Even Texas, if I get to work with Wendy Davis.

While the ban's backers can still ask the Supreme Court for a rehearing, the 25-day waiting period is not binding on lower federal courts, Vikram Amar, a constitutional law professor with the University of California, Davis law school, said.

"As a matter of practice, most lower federal courts wait to act," Amar said. "But there is nothing that limits them from acting sooner. It was within the 9th Circuit's power to do what it did."

In the name of all that is compassionate, merciful, and kind, in the name of Christ, please STOP fighting same-sex marriage. Remove your cruel and heartless motion for an injunction against people who are only doing what love and their true selves call them to do.

There is no possible way God could want you to be this insanely ugly about this. LGBT people never did any harm to any of you.

The court fight is over. You KNOW you have no chance of gaining standing to sue if the Supreme Court already denied it once.

Work for the things God would actually WANT you to work for...an end to war, an end to inequality and want, and an end to hatred among people.

Please.

Although I haven't read the SC decision on Prop 8, it appears that the major thrust of the decision was around standing, i.e. those attempting to defend Prop 8 against a decision taken by both a U.S. District Court and then the 9th Circuit, lacked standing. Standing is a fundamental requirement to bring a matter before any court.

For example, if you see someone hit your neighbor's car, you cannot raise a suit against the perpetrator. Only those with an interest in the matter have standing in the court. You can serve as a witness, can file amicus briefs, etc. but you have no legal basis to bring the matter before the court.

I suggest that the attorneys working for this rag tag organization should have their credentials checked. Any first year law student knows that one of the fundamental requirements to raise an issue before a court is standing. This is a last gasp attempt to perpetuate hate and discrimination.
