Appeals court upholds ruling striking down NYC's large soda ban

(Reuters) - New York City's plan to ban large sugary drinks from restaurants and other eateries was an illegal overreach of executive power, a state appeals court ruled on Tuesday, upholding a lower court decision in March that struck down the law.

The law, which would have prohibited those businesses from selling sodas and other sugary beverages larger than 16 ounces, "violated the state principle of separation of powers," the First Department of the state Supreme Court's Appellate Division said in a unanimous decision.

Mayor Michael Bloomberg had advanced the regulation as a way to combat obesity among city residents. Beverage makers and business groups, however, challenged it in court, calling it an attack on consumers' personal freedom.

I'm glad because it's M. Bloomberg because he's such a dick, and I'm glad because it was such an overreach of his power.

I freely admit I do not like Bloomberg.

I don't like him for the drink ban, for Stop and Frisk, his attack on Occupy, his anti-gun position, and his arrogance that he can do anything with the NYPD he wants to, no matter what laws he violates. In fact I despise the man just for his supreme arrogance that seems to say that he can do anything he wants to.

Bloomberg is a flat-out Authoritarian, and the fact some here on DU love him shows that there are closet Authoritarians everywhere.

Bloomberg is an overreaching, nanny state jackass. Sooner he's out of public office, the better.

And it was a very stupid law.
