No Deal: CBS Goes Dark On Time Warner Cable

BREAKING: CBS and Time Warner Cable negotiators failed to reach an agreement in their retransmission deal negotiations. This means that some 3M TWC customers in New York, Los Angeles, and Dallas will lose programming from their CBS-owned local stations, and all TWC subscribers will lose Showtime, TMC, FLIX, and Smithsonian. TWC customers who turn to CBS will see a graphic saying that “CBS has demanded an outrageous increase for programming that CBS delivers free over the air and online.” It tells viewers that they can use an antenna to see CBS, and “as a courtesy, we will provide replacement programming from Starz Kids and Family on a temporary basis beginning shortly.”

Separately, TWC says that “CBS has refused to have a productive discussion. It’s become clear that no matter how much time we give them, they’re not willing to come to reasonable terms.”

But CBS counters that the cable company “has conducted negotiations in a combative and non-productive spirit, indulging in pointless brinksmanship and distorted public positioning – such as the fictional and ridiculous 600% increase CBS supposedly demanded – while maintaining antiquated positions no longer held by any other programming distributor in the business.” The broadcaster adds it wants “fair compensation for the most-watched television network with the most popular content in the world. We will not accept less.”

Here’s CBS’ complete statement:

New York, N.Y. – August 2, 2013 – Effective 5:00 PM Eastern Time, Time Warner Cable has dropped CBS in New York City, Los Angeles, Dallas and several other markets. We deeply regret this ill-advised action, which is injurious not only to our many affected viewers, but also to Time Warner Cable itself. Throughout this process, Time Warner Cable has conducted negotiations in a combative and non-productive spirit, indulging in pointless brinksmanship and distorted public positioning – such as the fictional and ridiculous 600% increase CBS supposedly demanded – while maintaining antiquated positions no longer held by any other programming distributor in the business. CBS, for its part, is eager to make an agreement in line with the kind it has struck with every other cable, satellite and telco provider, and has continually sought reasonable term extensions to get that job done. This is the first time in its history that CBS has been dropped from a cable system. Time Warner Cable, on the other hand, has a long history of taking channels off the air – more than 50 in the last five years alone. It has also chosen to drop Showtime, which is owned by CBS, a move that is completely unnecessary and totally punitive to its subscribers.

We're Time-Warner country here in North Carolina and quit T-W cable TV a couple years ago. Off-air HD antenna does us just fine.
We only pay T-W for internet service -- gotta have my D-U ;0)

What assholes. I'd head for one of the satellite dish companies. AND get an antennae.

The attitude that two corporations can "solve" their dispute by fucking over the consumer is just an attitude that needs to be stomped. People need to vote with their feet and not go back.

I don't particularly care for my cable provider, but I've never seen that happen with them--particularly not with an over-the-air network channel. That's just assholishness.

LETTERMAN is on CBS...I suppose he's one of those "elderly" too....

After the towers came down and the transmitter atop them too, we were without any signals for any TV in my neighborhood for a while. All we could get was CBS and I'm not even sure if I remember how/why.

the next day or whenever. If I did, I'd be pissed I couldn't certain cbs shows I like in the fall.

Had to deal with time warner once upon a time.. glad that's over.

Put your address in and if it's green and you are within 20 miles, a basic antenna will get you Free HD CBS.

I have been wanting to dump Time-warner for a long time, but my husband likes their sports. Earlier this week, Lifetime and E were off and last night CNN and HLN were off. I am paying almost 80 dollars a month for the cable service and they just keep taking more programs away (lost True TV and TXN, only way to keep was pay $5 more per month). If CBS is gone, I am gone too.

Even if you have to hire an installer to put an antenna on your roof, cutting the cord will pay for that in a month or two. I get 16 OTA stations, most of them in HD. That's plenty enough for me. I remember when I had more than 100 channels I would sit there and scan the channels and often there wouldn't be even one program that I wanted to watch.

A funny little thing I picked up 15 years ago, maybe longer..it works..I get almost perfect reception...I get about 25 stations over the air....
I get the stations in HD...CBS too..every once in a while I watch Judge Judy or old eps of Star Trek..and play old video tapes..sometimes a dvd. I spend too much time on the computer. Lots of news gets put up here. I really don't know about the rest of the stuff. . I(I watch Judge Judy cause I like to see what a 2 million a week performer looks like...yep..2 million a week for about 25 weeks a year.)

I have a folded dipole I made it out of phone wire and PVC pipe. You can get a transformer AKA Balun to attach to the coaxial for the TV.

air it picks up channels. We don't have an actually have an antenna only cable in the building but the channels come in clear, perhaps because of the CBS broadcast range.

I have a family member in Los Angeles, lives in an apartment building that used to have TV antennas on the roof. Now it is either cable or nothing.

I am not sure, I think that the cable provider there is Time Warner.

perhaps somone should remind time warner about the " must carry rule " and remind them of their formation charter approved by the state repeat sate in which they were formed as to why they were established to carry over the air channels"'.

In 1992, giving in to the lobbying efforts of the broadcasters (led at the time by CBS), Congress amended the Communications Act to give broadcasters a win-win choice. They could assert a right to free mandatory carriage on local cable systems ("must carry&quot or they could elect "retransmission consent", in which case the broadcaster could demand payment in return for giving the cable operator its permission to carry the station's signal. The weaker stations (independent stations, home shopping stations, religious broadcasters) typically opt for must carry (unless they are co-owned with a major network affiliate). The major networks opt for retransmission consent.

Over the past few years, the broadcasters have escalated their demands for cash payments for carriage, going from an industry total of $215 million in 2006 to over $2.4 billion in 2012. Les Moonves, the head of CBS has publicly stated that "the sky's the limit" in terms of what CBS and other broadcasters can demand. Their goal is to get around $4 or $5 per subscriber per month. Remember, the broadcasters get access to the public airwaves for free. It's a license to print money granted to them by Congress.

Originally my thinking is in an outrage about all this NSA spying stuff, but also wondering if millions of Americans started a trend to dump cable, and satellite. Actually I did stop both and currently rent CD’s. My friend let me use his HBO series of Wired, 24, and Deadwood all three totally interesting.

Totally away from the twenty for hour news cycle of Fox the enemy, CNN the Ted Turner Tranny. Or, the MSNBC Bill Gates/ G.E./Federal Reserve Empire.

What all America needs to do is “not only” to send a message but to know how to receive a massage. Free air waves, the electromagnetic spectrum is public domain, America we the people give corporate America the one percenters the opportunity to conduct business “AND” serve the public which is not happening.

The FCC is auctioning off electric space too cheap. If it was done in the best way for the advantage of the public all those commercials could be good revenue that would pay for the deficit, double the needed payout for social security benefits, Healthcare would be paid for and here is the kicker, it would likely create more jobs. Rush Limbaugh and Hannity would have to advertise more which would be very cool tax money.
