White supremacists sentenced for N.J. hate attacks
Source: Philadelphia Inquirer
Two members of a New Jersey white supremacist gang -- who attacked several men of Egyptian descent and then boasted about the assault on a social media website were sentenced today after being found guilty on hate crime charges.
Michal Gunar, 29, a member of the Aryan Terror Brigade, admitted to his role in the beating in April when he pleaded guilty to an indictment charging him with conspiracy to commit a hate crime assault, as well as the actual commission of a hate crime assault.
In U.S. District court today, Judge Joel A. Pisano sentenced Gunar to 33 months in federal prison. Kyle Powell, 24, of West Collingswood, previously pleaded guilty to conspiracy to commit a hate crime assault. Judge Pisano sentenced Powell to 15 months.
According to court documents, Gunar attended a New Years Eve meet and greet for white supremacists at the home of Christopher Ising, 31, in East Brunswick on Dec. 31, 2011. Pumped up on alcohol and white supremacist music, Gunar, Powell, Ising, and up to five others drove to a Sayreville apartment complex to "hunt down some sand n------," Gunar later wrote.

(53,661 posts)These types are in every state, mostly going under their Second Amendment Solution banner now. They get liquored up and think they are Supermen.
I wonder how the victim is doing, because these sentences seem too light. Going out as a group with the intent of looking for someone to harm for racial, ethnic or political affliation not to their liking, deserves a lot more time in prison.
And I hope there are some limitations set on them there. I don't want these guys to align with like minded criminals and learn how to do more in custody. They should be taught they are not entitled to do this.
Although in talks with those who have worked with prison inmates, they indicated that part of the belief system that led to their being incarcerated is a sense of entitlement. That they don't have to follow any rules and that they were only doing what came naturally, be it rape, robbery, assault or murder. Or some other such rubbish.

No way around that. When you look at the area they WENT TO? They knew precisely what they were doing. There, New Brunswick, Edison, etc. etc. There is a large concentration of different ethnic groups and races in those communities and they went there with the intent of A) Easy Pickings and B) Because they could.
The arrogance of posting it on Social Media though? That's just over the top in the lack of empathy for another human being.

(11,360 posts)33 months is not that long either. You would think it could have been more.

(4,462 posts)The judge had little discretion. In fact, it's likely that both sentences were at the high-end of what was available to the Court.

Not bad for an unprovoked, racially motivated, blood soaked beating.

(4,462 posts)I really don't know the details of the case, but the defendants' lawyers appeared to have negotiated a very good deal.
Was the evidence particularly weak?

(5,861 posts)They posted pictures of their bloodied clothes on social media while posting they went out beating up sand ni***** and naming each other publicly.
Sounds like they just didn't want to be too hard on them. This was only a White attack on brown people.
Welcome to America. Are you new here?

(4,462 posts)Very disappointing plea bargains. Even considering the stereotypical negative view of Arabs by many of the public, I cannot imagine a NJ jury not returning a guilty verdict unless the case was far weaker than the news suggests. Given the harshness of the potential sentences with guilty verdicts, the the US Attorney's office should have held out for better deal.
Very, very disappointing.

(5,861 posts)It is about how much the DA was outraged by the crime(not that much). Again, welcome to America. It's a work in progress.

(18,807 posts)Usually if something like that is a known one the media shouts it from the rooftops; that goes double if it's Twitter or Facebook, both of which are popular to stir up outrage about these days. That they're not doing that implies it's somewhere else.

TRENTON, NJTwo members of the Aryan Terror Brigade white
supremacist group were sentenced to prison today for their roles in the
New Years Eve 2011 hate crime assault of two Middle Eastern men in
Sayreville, New Jersey, U.S. Attorney Paul J. Fishman announced.
U.S. District Judge Joel A. Pisano sentenced Michal Gunar, 29, of
East Windsor, New Jersey, to 33 months in prison. Gunar previously
pleaded guilty to an indictment charging him with conspiracy to commit a
hate crime assault, as well as the actual commission of a hate crime
assault, in violation of the Matthew Shepard and James Byrd Jr., Hate
Crimes Prevention Act. Judge Pisano sentenced Kyle Powell, 24, of West
Collingswood, New Jersey, to 15 months in prison. Powell previously
pleaded guilty to an information charging him with conspiracy to commit a
hate crime assault.
According to documents filed in this case and statements made in Trenton federal court:
Gunar admitted attending a New Years Eve meet and greet white
supremacist event at a residence in East Brunswick, New Jersey on
December 31, 2011. That night, Gunar, Powell, and Christopher Ising, 31,
of Waretown, New Jersey, drove to an apartment complex in Sayreville
with the express purpose of assaulting random, non-Caucasian
individuals. Gunar brandished a knife and attacked two Middle Eastern
men, shouting anti-Arab slurs. At his guilty plea proceeding, Gunar
admitted he assaulted at least one man by pulling the individual out of a
parked car and punching the man about the face and head, causing
physical injury.
Ising, a purported member of a white supremacist group known as the
Atlantic City Skins, previously entered a guilty plea on both counts of
the same indictment and charges as Gunar. He is scheduled to be
sentenced on August 9, 2013.

Michal Gunar, of East Windsor, N.J., and Kyle Powell, of West Collingswood, N.J., were charged with violating the Matthew Shepard and James Byrd Jr. Hate Crimes Prevention Act.
Gunar, 29, was sentenced to nearly three years after pleading guilty to assault. He also faces deportation to his native Slovakia.
Powell, 24, was sentenced to 15 months on a conspiracy charge. Both were part of the Aryan Terror Brigade, a supremacist group that exists mostly online and has more than 100 members.

Before issuing the sentences, Judge Joel Pisano told the men their blatant acts of racism against random victims requires a sentence that recognizes the seriousness of the offense and the outrage of it.
He nonetheless imposed the minimum terms negotiated in plea deals and agreed to allow Powell to defer the start of his term until he finishes school in December.
