GOP Congressman: Probably Have Enough Votes In House To Impeach Obama

Rep. Blake Farenthold, a Texas Republican, told constituents at a townhall over the weekend that the House of Representatives would probably have enough votes to impeach President Obama.
Farenthold was in Luling, Texas on Saturday, and after stepping past a question about the presidents birth certificate, suggested that the House would have the votes to impeach the president, but the Democratic Senate would kill the effort.
A question I get a lot If everybodys so unhappy with what the presidents doing, why dont you impeach him? Farenthold said.
Ill give you a real frank answer about that. If we were to impeach the president tomorrow, you could probably get the votes in the House of Representatives to do it, but it would go to the Senate and he wouldnt be convicted.

In that story Mark Twain had the African American Slave Governess to her master's kid, replace her child (who was only 1/32 African American), for her master's baby. That way her son received all of the privileges of being white, and her master's son received the education of a slave (i.e none).

Now, today the Census Department let people put down whatever race they think they belong to (and that has always been the rule for the Census department) but the states had different rules. Most of those rules came up in the days of Slavery. Furthermore remember this was the rule in all of the states when they had slaves and that mean ALL OF THE STATES, for Massachusetts, the first state to outlaw slavery, only did so AFTER the American Revolution (Most states North of the Mason Dixon Line outlawed slavery by 1848, through New Jersey had a handful of slaves as late as 1865).
Now, once you determined the race of someone, then two different legal rules kicked in. The "Southern Rule" and the "Northern Rule". The "Southern Rule" was if you were "Colored" you were presumed to be a slave unless you could prove otherwise, whites were presumed to be free. The "Northern Rule" made a presumption that no matter your race, you were free unless it could be shown you were a slave. In the Fugitive Slave Act of 1850, the Southern rule was extended to the whole country.
This difference was important, for if a African American was in the South, he could be arrested by the Sheriff and held by the Sheriff till his owner showed up (or he prove he was a freeman, but even then he had to pay the cost of the trial). If the owner never showed up, the Sheriff could sell the African American for the cost to keep him in jail (and thus a freed African American could end up being sold into slavery even if he had been born free).
Note, how the determination of race was tied in with presumption if you were a slave.
The "Southern Rule" was the rule even in Colonial days south of the Mason Dixon Line and the Ohio River. Louisiana was the only state that actually passed a law to codify the rule (this was due to Louisiana being a Civil Law Jurisdiction and unless it is in the legal code, it is NOT the law, unlike Common Law Jurisdictions where rules set by previous judges is the law UNLESS changed by Statute.
While Slavery was abolished in 1865, the legal rule as to race survived. Mark Twain made fun of it in
Pudd'nhead Wilson, for it was becoming the key to segregation in the 1890s.
To my knowledge, no state has ever overruled the above "Rule" as to someone's race. Several years ago Louisiana ran into a problem due to its rule being in its Statutes, but I have not heard what they did about it (and I can NOT find it on line, so I suspect they repealed it as embarrassing). Most Common Law States tend to ignore the rule for it is embarrassing today and in most cases using the rule is not needed to decide the case in front of them.
I bring this up, for most of the people pointing out Obama's race tend to follow this rule. A rule that American Courts at one time enforced. I.e. how much he is white is unimportant, that one drop of black blood makes him 100% black in their eyes.

What he's saying is, that they can't take it any further because the Senate would call their bluff. If it went that far all this hate talk that goes on in their circles would be dissected under the spotlight and it would be revealed that their cauldron of putrid hate is nothing more than unfounded propaganda.

And of course it wouldn't have a prayer in the senate. (It probably wouldn't even under a Republican senate, mind, since that house tends to be less batshit insane as a rule.)

(2,730 posts)You need two Thirds of the Senate to convict the President. You only need a majority of the House to impeach. Two Presidents have ben impeached, but none convicted. They were Bill Clinton and Andrew Johnson. Johnson missed being convicted by one vote.

(8,954 posts)Impeachment is merely an indictment, nothing more or less despite the associations and presumption of guilt that often accompanies that term. In Clinton's case, the charges brought against him cannot be described as non-impeachable (since Delay, Gingrich, Armey, "Youthful Indiscretion" Hyde et al got the necessary GOP majority votes in the House ), but were certainly non-convictable once the Senate took up the matter.

(18,652 posts)For those too young to remember, when Clinton was impeached by the House, Larry Flynt, founder of the Hustler empire, decided to investigate the sexual proclivities of those in charge of the impeachment proceedings. He quickly found a lot of dirt and started to publicize it. Suddenly, the House decided not to take the case to the Senate for conviction and the whole issue was dropped very quickly.
