A Manhattan federal judge finally confirmed this week what black and Latino leaders have long claimed: The NYPD has systematically violated the Constitution for more than a decade through massive stop-and-frisk practices that led to “selective enforcement of the law based on considerations of race.”

Judge Shira Scheindlin’s stunning 198-page decision on racial profiling marks a watershed moment for police-community relations in America’s biggest city. No matter how loudly Mayor Bloomberg, Police Commissioner Raymond Kelly and their apologists seek to denounce or appeal her ruling, they cannot erase the factual trial record Scheindlin has now established. Nor can they ignore the constitutional issues her opinion so eloquently dissects. Most of all, they can’t deny the damage done by more than 4 million stop-and-frisks since 2002 — nearly 90% of them of residents who did nothing wrong.

“While it is true that any one stop is a limited intrusion in duration and deprivation of liberty, each stop is also a demeaning and humiliating experience,” Scheindlin wrote. “No one should live in fear of being stopped whenever he leaves his home to go about the activities of daily life.”

Bloomberg and Kelly insist their policies have saved lives by taking guns off the streets. But at what cost?...
