California’s High Court Denies Petition To Reinstate Same-Sex Marriage Ban

The California Supreme Court turned down a petition Wednesday in which the sponsors of Proposition 8 sought to have the ban on same-sex marriage put back into effect in most of the state.
The court, in an order issued in San Francisco, declined to grant a hearing on the petition, which was filed July 12. The court made no comment in the order, which was signed by Chief Justice Tani Cantil-Sakauye.
Wednesdays court action appears to bring an end to pending litigation seeking to stop gay and lesbian weddings in the state, at least for the time being.

Has to be one of, if not the most liberal State in the USA.

With each election cycle the fundiegelicals here get crazier and crazier, and the crazier they get, the more outnumbered they get. I remember at the height of Prop (h)8 there were signs like every 5 feet down the main stretch of highway where I live. It just never ends.

(3,596 posts)The Supreme Court has ruled that the proponents of Prop 8 lacked standing to defend Prop 8.
In essence the Court held that the only parties with standing to defend Prop 8 were the competent governmental authorities in California such as the AG of California. Since they refused to defend the law, a decision by a U.S. District Court that held the constitutional amendment violated equal protection under the U.S. Constitution, was left standing.
This holding, in my opinion, creates an almost but certain outcome - state laws and constitutional amendments prohibiting same-gender marriage are unconstitutional.
It will take the right challenges, potentially in various Circuits, to validate this belief but I think the Court, while divided, quietly signaled that prohibitions on same-gender marriage were not consistent with the U.S. Constitution.
But remember that in the Anglo court system, the Court only considers the issue presented to it. So the Court was asked about the California case. It ruled on that case and the rest is for the appropriate broader case to be raised to invalidate legalized hatred of LGBT persons.

(1,342 posts)I could hardly believe the constant h8 and lies that saturated the air waves. Thankfully that h8ful thing is gone. I feel good knowing that the h8r's are reducing in numbers every year. After reading this thread, it made me think of Prop 8 the musical (w/Jack Black)...I just went to youtube to watch it again (great video).
