State offers Kaitlyn Hunt plea deal that would keep her out of jail

VERO BEACH, Fla. - Prosecutors are now offering Kaitlyn Hunt a new plea deal.

According to a letter Prosecutor Brian Orkman shared with WPTV, the new deal would keep Hunt out of jail.

Police say Hunt was 18 years old when she had sexual relations with a 14 year old girl.

If she accepted the deal, she would plea to two counts of misdemeanor battery and one count of felony interference with child custody.

As I posted before, Kaitlyn's mother has ZERO credibility in the stories she has told about her daughter from Day One of publicizing it. The best thing for her community and to avoid another media circus in Florida after Casey Anthony and George Zimmerman? TAKE THE FXXXING PLEA DEAL. That's the logical thing to do. But I doubt the average modern American teenager has any non narcissistic brain cells.

As if it's hard enough to defend liberalism in this age of right wing mythology dominating the internet and public opinion, the left fckued itself over a lot by trying to defend Kaitlyn. Publications like The Advocate and Slate have written sympathetically about Kaitlyn, and Chris Hayes had a long softball interview with Kaitlyn, Kaitlyn's mother, and Kaitlyn's lawyer on his MSNBC show All In in May (video) (transcript). And Ana Kasparian and Cenk Uygur have spoken in defense of Kaitlyn, for instance on the May 28 Young Turks:

The affidavit that was released proved they lied about the ages and how old the girls were when they met. I am surprised another plea deal was offered when she already turned down the first one. She should just take the darn plea deal already.

tolerance when the adult in the relationship is male. The law isn't written that way, but has that practical effect.

If these were medieval times and she was accused of witchcraft, she'd have already been drowned or stoned! I suspect this is what most of the people watching these disgusting 24/7 crime drama "news" programs would like to see.

It's so damn unfair that this teenager is only going being threatened with 15 years in prison as a sex offender, when others committing similar non-"crimes" might get even worse treatment.

Shoot them all and let God sort them out!

By no means what she did was right, but the offers being made by the prosecution are crap. They need to drop it to a single misdemeanor and be done with it.

The media reports into the latest offer is not completely accurate as not all of the terms are being disclosed.

In addition the prosecution has done some rather nasty things including make insinuations about the account people have donated into which has not be touched as well as bringing up past background about her parents.

You lambaste the Hunt's for the misinformation that was originally given (which has been corrected) yet it seems fair game when the prosecutor puts out misinformation and fails to correct it. All I'm doing is pointing out the obvious.

I also find it particularly disturbing that people are being voyeurs on a Facebook page that supports someone and go there specifically to use the information to attack the person. I'm not exactly sure where you are getting your information, whether it is directly through her Facebook page or through one of the hate sites, but it really is sad.

I as much as anyone would like to see this come to an end with some form of punishment, but until it does I'll continue to support her and her family.

For whatever reason the other girl's parents have a veto over what the State offers. Besides, can anybody tell me what happened in that relationship that would qualify as "felony interference with child custody". Here is the Florida statute.

As you can see, they are basically charging Kaitlyn with kidnapping under this statute and is thus a poor fit for what happened here. To find her guilty they would have to establish that what happened meets the legal definition of "taken" and it further requires proving "malicious intent" beyond a reasonable doubt. The "taken" part may not be all that hard because they would claim that the younger girl was enticed away and was unable to legally consent to going into that bathroom stall, though the narrow 3 1/2 year age difference does make the enticed charge a little more difficult. Proving malicious intent, however, looks like a tall order. I would recommend rejecting this offer. What the mom has offered up seems quite reasonable, however. The State should take it under advisement.

Running away from home after a fight with your parents hardly represents "taken", which is a requirement for kidnapping (which this new charge covers). And it really falls flat on it face when it comes to "malicious intent". The homophobic parents of the younger girl seems to be in charge here and one wonders why.

He's been doing a good smear job on the Hunts. If he goes for the full throat charges he's going to lose.

Even the judge seems to be changing his tone on the case and legislators are beginning to talk about changing the law so future cases like this don't occur. That in itself tell you there is something really messed up about the whole thing.

the main point of a plea bargain is to find some agreeable spot somewhere between scot-free and throw the book at 'em.

you then want the accused to plead guilty to a charge or set of charges that results in the agreed punishment. that charge, or those charges, may or may not be something that the defense could have easily prevailed at trial.

the accused agrees to plead guilty nevertheless, not because the plea bargained charge itself isn't beatable, but because rather to avoid trial on the original charges.

When the left closes ranks around a drug addicted hatemonger that gets caught coming back from a country notorious for child sex trafficking with viagra, then I'll admit we lost credibility. When we regularly attempt to force women to bear their rapist's child, then we'll have lost credibility.

Modern American teenagers aren't any worse than teenagers from any other generation.

This girl's prosecution is almost literally a Salem witchhunt. It is disgusting that they want to ruin her, whether by the draconian plea deal or the off-the-scale bloodthirsty alternative. The ones watching these disgusting anti-humanist "news" programs and howling for the girl's scalp, whether because homosexuality is the sin or out of a supposed hyper-formalist strict construction of "law." And a society that blindly sets up such laws without understanding the consequences at any point. (Can't they figure out an age difference?!) And a prosecuting arm that uses its ample discretion in this extremist fashion to punish the harmless in the most high-profile way possible. And they all sit in judgement of this girl, they get their moral rocks off this case, they preach hellfire for her and style themselves "morally superior," including on this "progressive board" -- they who pay taxes to imprison millions and drop bombs on millions more. Prosecutors contend Kaitlyn Hunt has repeatedly violated a pretrial order to have no contact with the victim in her teen-sex case — violations that could put Hunt back in jail, court records show.

The violations include secret meetings with “intimate physical contact” as recently as two weeks ago, according to a court motion filed by the State Attorney’s Office Thursday morning.

Hunt is facing trial and had been jailed on two felony charges of lewd and lascivious battery on the girl, who was 14 when Hunt was 18 and both were students at Sebastian River High School last year.

The new motion states Hunt has been in almost daily contact with the girl using an iPod, through Facebook and 20,000 text messages. It says that Hunt put an iPod in the girl’s locker at the high school on March 1, Hunt’s last day there, and over a period of several months used the iPod to contact the girl.

In addition to the text messages, “the state is in possession of over 25 sexually explicit photographs the defendant sent the child victim.”

In researching this story I came across the same link. I'm not sure how much to believe this because it would make no sense for the prosecution to propose a new, lesser plea deal with this as the background. So, is this part of a smear campaign or real news. We should know in a few days because it should lead to her being sent back to jail. At this point I am not discounting it but I am taking it with a grain of salt until something more reliable surfaces. The State Attorney's Office is not bound by law to tell the truth and they engage in character assassination all of the time. That is a sad fact. Also, note "Hunt is facing trial and HAD been jailed on two felony charges of lewd and lascivious battery". This is character assassination since those charges have been dropped. And the State Attorney should not be trying this case in the media -- the Judge needs to issue a gag order.

Thanks for the link. Mind boggling all around. Why would the State make a new plea bargain on one day with lesser charges and then the next day present the court with this boat load of new allegations with a notice of intention to file additional felony charges. It's like the left hand doesn't know what the right hand is doing. That, combined with the charge of 20,000 text messages since this spring, caused me to take this with a grain of salt. And why would the mom also violate the court order by contacting the younger girl and advise her to destroy evidence. Unreal. My guess is that her involvement will result in her having felony charges filed against her. Nobody in that family has learned the lesson of stop digging. And where has her attorney been while all of this is going on. I'm sure she advised both about the importance of complying with the conditions of the court order pending trial. She has obviously been too trusting. Lastly, how could the younger girl hide all of this activity from her parents for so long. I'm frankly surprised that they didn't have their daughter followed just to be sure they were not secretly hooking up given their extreme concern that their daughter not become a lesbian. The number of things that are just unreal truly boggles the mind.

State Attorney clarifies Kaitlyn Hunt’s plea deal in light of alleged violations

INDIAN RIVER COUNTY — State Attorney Bruce Colton said Thursday that the plea deal offered to now-19-year-old Sebastian River High School graduate Kaitlyn Hunt was offered in July – not the day before his office filed a notice of violation of her pre-trial release conditions.

The confusion stemmed from a court hearing held on Wednesday, during which the formalized, written version of the plea deal was presented – a day before Hunt was put on notice for communicating with her now-ex-girlfriend.

Colton said his office wanted on record the plea deal offered back in July. Having it as part of the record would prevent Hunt from filing an appeal – if later convicted on sex charges – based on her not having been notified of the plea deal.

Hunt declined the plea deal in July, Colton said.

The charges listed in the plea deal here is different than the charges listed in the plea deal reported a couple of days ago and they are different from the original release plea deal. Will we have a new report to clear up the confusion created by this latest release?


This has turned into another story where there are no good guys. Kaitlyn has surely screwed the pooch with her disregard for the court restrictions and she has not been served well by her mother either. This case has been poorly managed with lack of adult supervision so it has spiraled out of control. Like I say, no good guys to be found anywhere. Lot's of lives being ruined as a result.
